32 | During today's inspection, the licensee acknowledged that she has operated over her licensed capacity on several different occasions, as she misinterpreted the regulations. Licensee stated that not all children were at the facility in the same time as some children were at the park or the library under her assistants' care. Licensee stated she now understands the regulations and will change her procedures to operate within compliance.
During the course of the investigation, LPA conducted interviews with Licensee, staff and the reporting party. Based on interviews and documentation obtained during the investigation, it was determined that there is a preponderance of the evidence to prove that this facility was operating out of capacity on 4 different occasions between the months of April and May of 2023; therefore, the allegation is substantiated. Per California Code of Regulations, Title 22, Division 12, Chapter 3, a type B deficiency is being cited during today's inspection (see LIC 809-D). An exit interview was conducted with Licensee Eloisa Solorio. Licensee Eloisa Solorio was provided with appeal rights. |
