On 5/31/2024 Licensing Program Analyst (LPA) Miguel Herrera conducted an unannounced inspection to complete the complaint investigation that was received on 05/03/2024. LPA met with Eloisa Solorio to discuss the purpose of the inspection. LPA Herrera provided Spanish services to Licensee Solorio as she is a Spanish speaker. A tour of the home was conducted, and census was taken.
Upon review of the Licensee’s time sheets for the months of April 2023 and May 2023 it was observed by LPA Herrera that Licensee Solorio cared for up to 20 children on April 3, 2023. It was also observed that Licensee Solorio operated out of capacity several times throughout the day. On April 17, 2023, LPA Herrera also observed that Licensee Solorio cared for up 22 children and was operating out capacity several times throughout the day.
Furthermore, LPA Herrera observed that on May 1, 2023, Licensee Solorio cared for up to 22 children and was operating out of capacity several times throughout the day. Per timesheets, on May 22, 2023, Licensee Solorio cared for up to 22 children and operated out of capacity several times throughout the day.

During today's inspection, the licensee acknowledged that she has operated over her licensed capacity on several different occasions, as she misinterpreted the regulations. Licensee stated that not all children were at the facility in the same time as some children were at the park or the library under her assistants' care. Licensee stated she now understands the regulations and will change her procedures to operate within compliance.

During the course of the investigation, LPA conducted interviews with Licensee, staff and the reporting party. Based on interviews and documentation obtained during the investigation, it was determined that there is a preponderance of the evidence to prove that this facility was operating out of capacity on 4 different occasions between the months of April and May of 2023; therefore, the allegation is substantiated. Per California Code of Regulations, Title 22, Division 12, Chapter 3, a type B deficiency is being cited during today's inspection (see LIC 809-D). An exit interview was conducted with Licensee Eloisa Solorio. Licensee Eloisa Solorio was provided with appeal rights.

Staffing Ratio and Capacity. The capacity specified on the license shall be the maximum number of children for whom care may be provided at any one time. The total licensed capacity for a Large Family Child Care Home shall not exceed 14 children.

Licensee states she no longer cares for more children than her allowable capacity. Licensee Solorio will submit a statement indicating that she will not care for more than 14 children at a time. Additionally, Licensee will inform parents that she will not be able to care for his/her child, if at capacity on that day.

The licensee operated out of capacity on 04/03/2023, 04/17/2023, 05/01/2023 and 05/17/2023, as demonstrated on the subsidized timesheets. This is a potential risk to the health, safety, or personal rights of children in care.

Furthermore Licensee will watch CCLD's "HOw Many Children Can Attend a Family Child Care Home" video and will provide a written statement by the end of the day on 05/31/2024 via text or email.
