On 10/10/2024, Licensing Program Manager (LPM) Cynthia Brannon, Licensing Program Analysts (LPAs) Valerie Mireles and Aurelio Mendoza met with Licensee, Maria Elena Velasco, also present was Licensee’s Assistant. Licensee is Spanish Speaking; therefore, LPA Mendoza assisted with Spanish interpretation.

The purpose of the informal conference was to discuss previous deficiencies cited during past inspections that were conducted on 05/10/2023, 01/04/2024, and 08/20/2024. LPM Brannon reviewed and discussed the deficiencies with Licensee and how the Family Child Care Home will maintain compliance with the deficiencies cited below. Licensee has implemented a plan of correction since facility was cited.

It should be noted that, on 03/11/2020, Community Care Licensing (CCL) held a Non-Compliance Conference with the Licensee and was cited a Type A deficiency for a violation of CCR102352(f)(1)&(h)(1). Based on LPA observations and interviews, Licensee did not maintain the childcare facility as her primary place of residence as required by the License.

The Department of Social Services, CCL Division has determined that Maria Elena Velasco Family Child Care Home violated the following Title 22 licensing regulations/California Health and Safety Codes:

The following Type A violations were discussed:

· On 08/20/2024 – Personal Rights: CCR102425(h)(i) LPA observed sleeping infant in stroller car seat combo in master bedroom with door closed. Per licensee, infant was asleep in the car seat combo for 15 minutes, and 30 minutes before licensee removed infant from car seat, after multiple requests by LPA.

The following Type B violations were discussed:

· On 08/20/2024 – Infant Safe Sleep: CCR102425(j)(1)(2) Licensee pre-filled safe sleep log for future dates from 08/31/2024 through 10/27/2024 with licensee's initials. This poses an potential risk to the health, safety, and personal rights of children in care. Continued to LIC809-C.

· On 01/04/2024 – Infant Safe Sleep: CCR102425(j)(1) Based on record review, Licensee did not comply with the section cited above. There was no documentation that Licensee physically checking on Child #1 (CH1) every 15 minutes when CH1 was sleeping. Licensee had documentation for Child #2 (CH2); however, the last recorded 15-minute sleep log for CH2 05/26/2023.

· On 01/04/2024 – General Provisions and Definitions: HSC1597.622(a)(1) Based on interview and record review, the licensee was unable to provide proof of her pertussis, measles and influenza immunizations for herself and her assistant.

· On 01/04/2024 – Infant Safe Sleep: CCR102425(c) Based on interview and record review, the licensee did not comply with the section cited above. Licensee did not have the LIC 9227 for an infant in care.

· On 05/10/2023 – Administration of Child Day Care Licensing: HSC1596.8662(b)(1) Based on record review, the licensee did not comply with the section cited above as she and her two assistants did not have updated mandated reporter training.

In response to these discussions, Licensee has agreed to the following:

Licensee will ensure children are provided with a safe and healthful environment and the home shall be free from defects or conditions which might endanger a child. Licensee will ensure compliance with safe sleep regulations.

During today's meeting, Licensee Maria Elena Velasco, verified that 1708 Rosario Ave., Modesto, CA 95355 is her primary residence and does not reside elsewhere. Licensee will provide a copy of a current mortgage statement no later than 11/01/2024. Licensee agreed to stay in compliance with Title 22, Division 12, Chapter 3 regulations at all times.

It was discussed that continued violation of California Code of Regulations and Health and Safety Code Laws related to Family Childcare Homes may result in a Non-Compliance meeting and/or referral to the California Department of Social Services Legal Division for possible Administrative Action.

A copy of the signed report was read aloud and provided to Licensee, Maria Elena Velasco. No Deficiencies Cited during today’s Office Visit.
