On 04/12/2024, Licensing Program Analyst (LPA) Anita Tristan and Licensing Program Manager (LPM) Cynthia Brannon conducted an unannounced complaint inspection to provide findings for the above allegations. LPA and LPM met with Licensee, Kelly Oliver. LPA Tristan reviewed the allegation, toured the facility, inside and outside. A census was taken where LPA and LPM observed 4 children in the front day care room. Also present was licensee's adult son and daughter.
Based upon LPA Tristan’s observations and information gathered through interviews, the preponderance of evidence standard has been met, therefore the above allegation; staff does not transport children in car seats is found to be SUBSTANTIATED.

Per California Code of Regulations, Per Title 22, Division 12, Chapter 3, the following deficiency Type B is being cited (see 9099-D)

Exit interview conducted with Licensee, Kelly Oliver and Appeal Rights were given and discussed.
A notice of site visit was given and must remain posted for 30 days.

On 04/12/2024, Licensing Program Analyst (LPA) Anita Tristan and Licensing Program Manager Cynthia Brannon conducted an unannounced complaint inspection. The purpose of the inspection was to deliver investigation findings. LPA and LPM met with Licensee, Kelly Oliver. A tour of the facility was conducted, and a census was taken. LPA and LPM observed 4 children in the front day care room. Also present was licensee's children.
During the course of the investigation, LPA received and reviewed pertinent documentation, which included facility children’s roster, reviewed personnel files, and the facility’s Criminal Record Clearance printout. LPA also conducted interviews; however, based on inconsistent statements during interviews, the allegations are UNSUBSTANTIATED. Although these allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations.

Per California Code of Regulations, Title 22, Division 12, Chapter 3, no deficiency is cited during today’s visit. Exit interview conducted with the Licensee, Kelly Oliver.

Licensee is to review the CCL video “TRANSPORTING CHILDREN.” Licensee is to submit a written statement that she has reviewed the video and submit new written protocol

Based on interview with Licensee the proper seat restraint system was not used when transporting children in care. Per California Highway Patrol State Law Children under the age of 8 years old must be secured in a car seat or booster seat in the back seat. This poses a potential risk to the Health, Safety and Personal Rights of children in care.
