On 04/11/2024, Licensing Program Manager (LPM) Cynthia Brannon and Licensing Program Analyst (LPA) Valerie Mireles met with Licensee, Tara Weber, also present was Licensee’s Assistant.

The purpose of the informal conference was to discuss previous deficiencies cited during past inspections that was conducted on July 1, 2022, March 14, 2024, and March 27, 2024. LPM Brannon reviewed and discussed the deficiencies with Licensee and how the Family Child Care Home will maintain compliance with the deficiencies cited below. Licensee has implemented a plan of correction since facility was cited.

The Department of Social Services, Community Care Licensing Division has determined that Tara Weber Family Child Care Home violated the following Title 22 licensing regulations/California Health and Safety Codes:

The following Type A violations were discussed:
· On 03/14/2024 – Staffing Ratio and Capacity: CCR 102416.5(e) There were 11 children: one infant and 10 preschool age children in care without an assistant present, causing the facility to be out of capacity, as licensee was the only adult in the home.
· On 03/14/2024 – Personal Rights: CCR 102423(a)(4) The licensee used corporal punishment by spanking a child on the bottom with her hand for not listening to her.

The following Type B violations were discussed:
· On 07/1/2022 - Staffing Ratio and Capacity: CCR 102416.5(d)(1) There were 12 children at the time of inspection which included five infants.

· On 03/14/2024 – General Provisions and Definitions: HSC 1597.622(a)(1) Staff #2 did not have documentation of immunization on file.

· On 03/14/2024 – Infant Safe Sleep: CCR 102425(c) Infant file did not contain LIC9227 form.

· On 03/14/2024 – Personal Rights: CCR 102423(a)(2) Licensee did not ensure children in care were not subject to observing an inappropriate crime documentary discussing graphic topics and scenes which may frighten, traumatize and/or cause distress a child in care.


· On 03/27/2024 – Infant Safe Sleep: CCR 102425(b) Child #1 had toys surrounding them in the play yard while asleep.
· On 03/27/2024 – Infant Safe Sleep CCR 102425(d) Child #1 was sleeping on their stomach in the play yard.
· On 03/27/2024 – Operation of a Family Child Care Home CCR 102417(d) The tricycle was missing rubber handles exposing metal.
· On 03/27/2024 - Child's Records 102421(b) Licensee revealed that Child #2 and #3 did not have their own files.

In response to these discussions, Licensee has agreed to the following:

Licensee will ensure children are provided with a safe and healthful environment and the home shall be free from defects or conditions which might endanger a child.

Licensee agreed to stay in compliance with Title 22, Division 12, Chapter 3 regulations at all times.

It was discussed that continued violation of California Code of Regulations and Health and Safety Code Laws related to Family Childcare Homes may result in a Non-Compliance meeting and/or referral to the California Department of Social Services Legal Division for possible Administrative Action.

A copy of the signed report was read aloud and provided to Licensee, Tara Weber. No Deficiencies Cited during today’s Office Visit.
