On 08/31/2023, Licensing Program Analyst (LPA) Martha De Haro, conducted an unannounced complaint inspection to provide findings regarding the above allegation. LPA met with licensee Yesenia De La Torre, toured the facility, and took a census. LPA explained and discussed the allegation and findings with Ms. De La Torre.

LPA investigated the above allegation. During the course of the investigation, LPA interviewed staff, parents, conducted facility observations, and reviewed and obtained facility records. During licensee’s interview, she indicated that she has allowed her 16 year old son to watch the daycare children when she has needed to leave, sometimes occurring twice a week. Based upon information gathered through interviews and facility records, the evidence standard has been met, therefore, the above listed allegation is found to be SUBSTANTIATED.

Per California Code of Regulations Title 22 Division 12 Chapter 1, the following deficiency is being cited (see LIC 9099-D).

An exit interview was conducted with Ms. De La Torre. A copy of this report and Appeal Rights were provided and discussed with Ms. De La Torre. Notice of Site Visit to be posted for 30 days.

The licensee shall be present in the home and shall ensure that children in care are supervised at all times. When circumstances require the licensee to be temporarily absent from the home, the licensee shall arrange for a substitute adult to care for and supervise the children during his/her absence.

Licensee has been made aware that children can only be left alone with a qualified adult during daycare hours. Licensee was provided with resources available to providers via the Department’s website. Website information and steps for accessing the videos was provided.

Temporary absences shall not exceed 20 percent of the hours that the facility is providing care per day. This requirement was not met as evidenced through interviews with licensee. This poses a potential risk to the health, safety, and personal rights of children in care.

Licensee agrees to watch a training video on Supervising Children in Family Child Care and submit a written statement of what she learned from the video via email by the Plan of Correction Due date, 09/14/23.
