25 | An office meeting was conducted today in the Sacramento Regional Office via Microsoft Teams. The purpose of this meeting was to discuss audit compliance and penalty issued by the Department of Labor. Present at the meeting was Regional Manager (RM) Krystall Moore, Licensing Program Manager(s) Stephenie Doub and Yvonne Flores-Larios, Licensing Program Analyst (LPA) Grace Luk, Jacqueline Juarez and Jessica Chen Auditors, Fetus "John" Osuka and Ada Osuka representatives of Delta Star Home Care LLC and Jacob Reinhardt attorney representing Delta Star Home Care LLC.
On February 6, 2021 an Non-Compliance Conference was held to discuss the audit findings. It was agreed during the NCC that the licensee would provide monthly documentation to the audit department for solvency monitoring. These documents were to be submitted quarterly and were due on April 15, 2021 but have yet to be received by the Department. The facility was also cited civil penalties from the Department of Labor (DOL). On May 7, 2021 the Department was notified by DOL that the civil penalty was still outstanding. The licensee representatives reported that the civil penalties had been paid about three weeks ago.
The licensee representatives agreed to the following to remain in compliance:
- provide proof of civil penalty being paid
- submit audit monitoring documentation by close of business June 11, 2021
- continue to provide documentation quarterly, with the next documents due on July 15, 2021
- provide proof of workmen's compensation insurance
- financial monitoring would be conducted for one year
Per California Code of Regulations (CCRs) - Title 22, Division 6, Chapter 8, no deficiencies are being cited during this visit. An exit interview was conducted with representative Ada Osuka via telephone and a copy of this report was provided via email and an electronic email read receipt confirms receiving these documents. |
