32 | Three staff (S1 – S3) were interviewed on 04/28/26 and S3 had no knowledge of the allegations stating that S3 was not present on the day of the incident. S1 had knowledge of the allegation stating that S1 had heard W1 make inappropriate comments towards child C1 on 03/17/2026. S1 stated that W1 had made comments towards C1 like “I can do this all day”, “I am just getting my steps in” and “ I have no sympathy for this today” in a threatening way while C1 was escalated and trying to elope from the facility. S2 had no knowledge of the allegation stating that S2 did not hear W1 speak to child C1 in an inappropriate manner.
Two Witnesses (W1 – W2) interviewed on 04/28/26 and 07/13/26 and W2 had no knowledge of the allegation W2 stated that W2 did not hear any inappropriate comments made by W1 when W2 was in the building, W2 did state that C1 was visibly upset. W1 denied the allegation and stated that W1 did make comments about getting W1’s steps in all day and not having sympathy for bad behavior but that it was taken out of context and misinterpreted. W1 stated that the comments were not made at child C1 but were made in general conversation and were not intended to be threatening to C1. W1 also stated that the comments were not made at the time that C1 was escalated and that the timing of the comments has been confused.
One Parent P1 was interviewed on 04/28/26 and had no knowledge of the allegation stating that P1 was not present at the time of the incident and did not come to the facility for pick up that day.
During the investigation the facility was toured and LPA Sims conducted interview with staff, parent, and witnesses.
Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred, and the findings are unsubstantiated.
Exit interview conducted and report was reviewed with the facility representative Bonnie Phillips. Appeal rights were provided.
A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. |
