On 3/10/22, Licensing Program Analyst (LPA) Carrie Wisehart, conducted a subsequent complaint investigation inspection to the facility for the purpose of delivering complaint findings. It was alleged facility is not following COVID-19 protocols.

The licensee was interviewed on site on 3/2/22 and indicated that the facility requires the public entering the building to wear masks; hand washing is required upon entry; temperatures checks are completed and children with signs of a temperature or illness are isolated and sent home. The staff sanitize the rooms, toys and instruments used throughout the day after use of the item(s). When a child is on the diaper table, the table is wiped down after each use so as it’s ready for the next child. The thermometer is sanitized after each use. The licensee acknowledged that staff and children do not wear a mask, but that masks, gloves and sanitizers are available for use at the facility by anyone who wants them.

The LPA interviewed 2 out of 2 staff on 2/3/22 who confirmed that COVID protocols are being followed other then mask wearing by children and staff. Interviews with 4 out of 4 children indicated that they must wash their hands often but that they don’t wear masks. Interviews with 6 out of 6 witnesses indicated no concerns with how the facility has been enforcing COVID protocol’s, however, they also confirmed that parents wore masks into the building, but that staff and children did not. Some witnesses expressed they were not supportive of masks being worn as they felt the children needed to see the teacher’s faces for proper language development and interactions.

The LPA observed on 3/2/22, 3 staff and 13 children without masks on. The LPA during facility tour observed that masks, gloves and sanitizer supplies were present in the facility. The LPA also observed in the bathroom a changing table, and that gloves and sanitizer were present. The LPA also observed on the entrance door a sign requiring masks upon entry. The LPA has determined that though the facility is following the majority of the COVID safety protocol’s, the staff and children did not wear masks as required per CDPH and Cal/OSHA mask requirements and as required by the Order of the State Public Health Officer (June 11, 2021), and an individual face covering exception did not apply. The LPA printed and reviewed the Governor’s Updated Health Guidance Published 2/28/22 and reviewed that though the mask guidance is being lifted on 3/11/22 at 11:59 pm, they are still encouraged and that local jurisdictions may have additional requirements beyond the state guidance.The LPA also printed and reviewed PIN 22-10 (3/9/22) Updated Guidance for Child Care Providers Regarding Coronavirus Disease.

Based on the evidence obtained, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated.


Notice of Site Visit shall be posted for 30 days from today's visit.

The following violation(s) of the California Code of Regulations, Title 22; Division 12, were observed: see LIC 809D. Appeal Rights were provided.

. This requirement was not meet as evidenced by: Based on observations and interviews the director did not ensure the personal rights of children in care in that 3 staff and 13 of children in care did not wear face coverings while in the facility, as required by the Order of the State Public Health Officer (June 11, 2021), and an individual face covering exception did not apply. This is a potential health and safety risk to children in care.

The director agrees to immediately require the wearing of masks when required by state or local mandates. The director agrees to train the staff on the Governor’s update heath guidance and follow local jurisdiction requirements if more restrictive then the state guidance. The licensee will send to CCL a training log including date of training; topics covered and signatures of staff to CCL by 3/11/22.
