On 3/10/22, Licensing Program Analyst (LPA) Carrie Wisehart, conducted a subsequent complaint investigation inspection to the facility for the purpose of delivering complaint findings. It was alleged that staff inappropriately disciplined a child by putting a child on time out because they put their fingers in their mouth and that staff made an inappropriate comment towards day care child by calling the child too fat to use a piece of playground equipment.

The licensee was interviewed on site on 3/2/22 and denied the allegations. The licensee indicated that children are not put on time out for sucking thumbs or putting fingers in their mouths, though they may re-direct the behavior and wash their hands. The licensee indicated she was made aware of a child who said a teacher called the child “too fat” to use a tricycle made for 2 year old’s. The licensee when investigating the concern, indicated finding no supportive evidence that the incident occurred, after speaking with the child’s responsibly party and the child was not able to identity the teacher involved.

The LPA interviewed 2 out of 2 staff who confirmed that time outs are not used for thumb or finger sucking, though staff will remind children that the mouth is where germs live and encourage them to redirect and wash and sanitize often. The interviews also indicated that they have not spoken inappropriately to children and that when an older child tries to get onto the tricycle for the younger children, they will redirect by saying “that’s for the 2 year old’s” because children know their ages or they will say “oh my friend, that is for our little friends”.The LPA interviewed 4 out of 4 children who have seen children put their fingers in their mouth or suck their thumbs, but none could identify ever seeing someone put on time out for it. The interviews also indicated that they can play on the playground equipment, however, staff may tell them they can’t ride the small tricycle because they might “pop the tires”. The LPA interviewed 6 out of 6 witness interviews who indicated the only discipline they were aware of where time outs and none had heard of any time outs being given for thumb sucking or fingers in mouths. The witness interviews also expressed the staff interact with love and they have never seen the staff belittling children.

The LPA’s could not determine if a child was placed on time out for putting a thumb or fingers in their mouth or if they may have been placed on time out for other reasons and may have attributed it to the behavior. The LPA also could not determine if a staff called a child "too fat" to ride on a tricyle, of if the child was told something like they may "pop the tires" and interpreted that as being "too fat".

Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred, and the findings are unsubstantiated.
