On this date Licensing Program Analyst (LPA) Adrian Pizano and Licensing Program Manager (LPM) Luisa Gavoutian conducted an unannounced Case Management inspection. LPA and LPM met with Director Holly Oliviera, toured the facility, and took a census. The purpose of today’s inspection was to discuss an incident that was reported to Community Care Licensing (CCL) on 03/05/2024.

On 03/05/2024, at 10:35am, a toddler (Child 1) escaped from the facility via an unlocked gate on the side of the playground and was found in the middle of the street by the front neighbor.

The director, who directly witnessed this incident, stated that she noticed from the front classroom window a vehicle blocking the exit driveway. The director went out to investigate at 10:39am when she saw the front neighbor holding Child 1. Director stated that the side gate was left unlocked due to the handyman fixing the playhouses on the playground. Director viewed security footage from the incident and saw the child had been missing for 4 minutes. Director stated during the time of the incident there were 6 staff members and 44 children. The Porterville Police Department was contacted by the front neighbor. Director contacted Child 1 parent to notify them of the incident, then contacted Community Care Licensing (CCL) to report the incident.

LPA observed construction taking place on the West side of the playground that Director stated began on 03/05/2024. Director stated that children were using the playground on 03/05/2024 but have not been using it since. Three structures are being remodeled and painted. Children are currently using the smaller sectioned off play area underneath the covered patio. LPA also observed newly cemented areas on the South side of the playground. Director stated that the cemented areas were completed at the end of January 2024.

On 03/05/2024, at 6:00pm the director stated that a mandatory all staff meeting was held to discuss the severity of the incident. The Director stated that a staff member will always stand next to the gate during outdoor play time.

Director acknowledged that due to a lack of supervision of staff not monitoring the safety of the outdoor play area, Child 1’s health and safety were adversely impacted.

Per Chapter 1, Division 12, Title 22 of the California Code of Regulations, the following deficiency is found: Child 1 exited the facility unsupervised and was found in the street by the front neighbor. (See LIC809-D).

Upon receipt of a Type A violation, Licensee shall post the Type A report immediately and for the next 30 days. Copies of the Licensing report shall be provided to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. Health & Safety Section 1596.859(a) shall be cited and a civil penalty of $100.00 for failure to provide copies to parents/guardians of children in care and newly enrolled children, and for failure to maintain written verification of receipt of licensing reports indicating a Type A violation (Acknowledgement of Receipt of Licensing Reports - LIC 9224).

An exit interview was conducted, and the report was reviewed with Director, Holly Oliveira. A copy of appeal rights and Notice of Site Visit was given and must remain posted for 30 days. Continued to LIC809-D.

The Licensee shall provide care and supervision as necessary to meet the children’s needs. No child shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230 (c)(1). Supervision shall include visual observation.

On 03/05/2024, the Director held a mandatory all staff meeting. An action plan includes the following: a staff member will always stand next to the gate. Director stated all staff are to review the CCLD video SUPERVISING CHILDREN IN CHILD CARE CENTERS.

This requirement was not met as evidenced by Director self-reporting incident. On 03/05/2024, Child 1 exited the facility through a side playground gate unsupervised. This poses an immediate risk to the health, safety, or personal rights of children in care.

Director is to submit a signed staff roster as evidence that ALL staff reviewed the CCL video by 03/27/2024. NCC has been scheduled for 03/29/2024 at the Fresno South Child Care Regional office.
