On 9/17/2021, Licensing Program Analyst (LPA) Ocegueda conducted a case management inspection for the purpose of addressing an Unusual Incident that was reported to the Department on 8/31/2021. LPA met with Director Rachel Sanchez and informed her of the reason for todays inspection. A tour and a census was taken today.

On 8/31/2021, Director Rachel Sanchez self-reported to the Department that child #1 re-entered the building while he/she was playing outside with the rest of his/her classroom. Child#1 presumably entered through classroom #3 without staff supervision and was found outside of classroom #2. Child was missing for approximately 5 -15 minutes and was found by staff#1 while staff #2 (child#1’s assigned teacher) had already noticed he/she was missing. Per Director, staff #2 noticed child was missing once the class re-entered their assigned classroom (classroom #3). Child #1 was found whimpering outside of the door of classroom #2 which faces a chain link fence and the street.

Today, LPA reviewed the incident with Director Sanchez and she confirmed that child #1 was left without supervision for approximately 5-15 minutes. Director Sanchez stated that since the incident occurred, the facility is training their staff on being at their stations at all times so as to supervise children during outside play and indoor activities. Director also has discussed with licensee other ways to help ensure that children do not walk through any doors unattended (such as chimes on the doors). LPA observed that the door where child was found, faces the approximately 4 foot tall chain link fence that faces the street. The approximately 4-foot chain link fence wraps around the facility and has a door (that faces the parking lot). The door has a latch but remains unlocked for fire safety. Per Director Sanchez, all doors remain unlocked for fire safety reasons. LPA discussed keeping the doors unlocked but placing child safety doorknob covers on the doorknobs as an added measure to prevent children from walking out of the classrooms. Director Sanchez stated the facility staff communicated the incident verbally to the parents. Child did not sustain any physical injuries while unsupervised. Report continued on 809-C.

An exit interview was conducted with Director Sanchez.

Per Title 22, Division 12, Chapter 1, of the California Code of Regulations, the following deficiency is being cited: (see next page, 809 D) Director was provided a copy of their appeal rights.

Upon receipt of a Type A violation, licensee/Director shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. A copy of the Fact Sheet - Child Care Parent Notification Requirements and a copy of LIC 9224 was given to licensee.

This report shall be made available to the public upon request. LIC 9213 Notice of Site Visit is provided and required to be posted for 30 days.

This requirement was not met as evidenced by: interview. Director and Licensee confirmed that child#1 was left without supervision for approximately 5-15 minutes. This poses an immeidate risk to the health, safety and or personal rights of children in care. An immediate 500.00 civil penalty was imposed today.
