On 3/18/2022, Licensing Program Analyst (LPA) Theresa Marquez conducted a complaint inspection and met with licensee, Mirna McWilliams. Assistant Daniela Ramirez was also present. The purpose of this inspection is to provide complaint findings regarding the above allegations.
During the course of the investigation, LPA conducted interviews with licensee, parents and day-care children. Interviews revealed there was insufficient information to prove that licensee patting children's head or yelling at children resulted in a Personal Rights violation.
Although the allegations may have happened or are valid, there is not a preponderance of the evidence that violations occurred; therefore, the allegations that licensee hit a child and an adult in the facility yells at children are unsubstantiated.
Per California Code of Regulations, Title 22, Division 12, Chapter 3, no deficiencies were cited on this report. An exit interview was conducted with Mirna McWilliams.
The Appeal Rights and A Notice of Site Visit was provided to McWilliams.

On 3/18/2022, Licensing Program Analyst (LPA) Theresa Marquez conducted a complaint inspection and met with licensee, Mirna McWilliams. Assistant Daniela Ramirez was also present. The purpose of this inspection is to provide complaint findings regarding the above allegations.
During the course of the investigation, LPA conducted interviews with licensee, parents and day-care children. The investigation revealed that day care children were familiar with, and named an uncleared adult who has been present in the facility while the children were in care.
LPA inspected the backyard of the home on 1/19/2022, 3/14/2022, and on 3/18/2022, and observed pet feces about the yard from licensee's 3 dogs.
Based on the information obtained during the investigation, there is a preponderance of the evidence to prove an uncleared adult has been present in the facility and the facility is unsanitary, therefore, the allegations are substantiated. An exit interview was conducted with Mirna McWilliams. The Appeal Rights and A Notice of Site Visit was provided to McWilliams.

OPERATION OF A FAMILY CHILD CARE HOME- The home shall be kept clean and orderly, with heating and ventilation for safety and comfort. This requirement was not met as evidenced by LPA observation.

Licensee agreed to move her 3 dogs to the gated swimming pool area during day care operating hours and ensure she removes all feces, if any, in and around the play area surrounding the gated swimming pool.

On 1/19/2022, 3/14/2022 and 3/18/2022, LPA Marquez observed several small piles of dog feces present about the backyard area from licensee's 3 dogs. This poses a potential risk to the health and safety or personal rights of children in care.

On 2/4/2022 the uncleared adult was processed by LIVE SCAN for DOJ, FBI and Cachi CA fingerprint clearance. Licensee agrees that the uncleared adult will not be present at the day care home during operating hours
