25 | On 7/29/2024, Licensing Program Analyst (LPA) Claribel Soto and Licensing Program Manager (LPM) Scott Herring, conducted an unannounced case management inspection. LPA met with Licensee, Karen Moreno Lemus. LPA toured the home inside and outside and a census was taken. The purpose of today's inspection was to inspect the inaccessibility of the above ground pool in the backyard.
The above ground pool in an off-limits area in the back yard. The pool has a netting that covered the pool but the netting appears to be loosely attached to the top of the above ground pool structure and can be easily pressed down by hand pressure. LPA Soto and LPM Herring took photos for further review. Licensee will submit manufacture’s guide and written statement requesting a waiver to utilize the pool netting as is to LPA.
The backyard has a gate that opens to the pool but is not self-latching, self-closing and does not open away from the swimming pool. The fence does not surround the pool. The pool is accessible from the parking lot. No windows or doors have direct access to the pool area. LPA measured the pool fence all around and it was observed that some areas of the pool gate did not meet the 5 ft height requirement. Some areas were less than 5 feet tall. Currently there is no water in the pool and licensee stated she would not put water in the pool until the netting cover and pool was reviewed and approved for use by the Fresno Regional Child Care office. Licensee states that she will continue to make the pool area off limits and inaccessible to children in care.
An exit interview was conducted with licensee Karen Moreno Lemus.
Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, no deficiency is being cited.
Notice of Site Inspection to be posted for 30 days.
