Licensing Program Analyst’s (LPA’s) Sarah Hurt and Ruth Wallace arrived at the facility unannounced to deliver complaint findings on the above allegations. LPA’s met with Administrator Michael Maloney and explained the purpose for the visit.
Regarding the allegation that staff did not provide adequate supervision. LPA’s observed sufficient staff for resident care. LPA’s reviewed a current staff schedule and it reflected sufficient staffing levels. LPA’s interviewed staff on shift at facility and they all agreed the facility has recently hired several caregivers and are currently in the process of hiring more. The facility has 50 residents and there are 2 caregivers downstairs covering each hallway, one caregiver on the second floor with more independent residents, and one on the first floor. There is also a medication technician which can assist with caregiving once medications are being dispersed. Therefore, the allegation is deemed UNSUBSTANTIATED. A finding that the complaint is unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation did or did not occur, therefore the allegation is unsubstantiated.

Regarding the allegation that a resident was inappropriately dressed. The complainant did observe this on a recent visit to the facility. Despite the eyewitness description the facility has several residents with severe dementia that despite sufficient staffing have walked out of their rooms disrobed. LPA's reviewed the 602’s of several residents which stated their diagnosis as dementia. LPA's interviewed several staff members who all stated despite their best efforts these incidents do happen and residents are redirected. Therefore, the allegation is deemed UNSUBSTANTIATED. A finding that the complaint is unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation did or did not occur, therefore the allegation is unsubstantiated.

Regarding the allegation that there was an unsafe electrical cord accessible to the residents. The complainant observed this on a recent visit to the facility. The electrical cord was hooked up to the emergency lights and to one of three generators for the facility due to the fire that was approximately 150 feet away. The generators were on for 36 hours during the power outage in the area. Therefore, the allegation is deemed UNSUBSTANTIATED. A finding that the complaint is unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation did or did not occur, therefore the allegation is unsubstantiated.

Regarding the allegation that staff expressed the inability to manage resident behaviors. A similar complaint was addressed on 10/14/2021 and facility was cited for personal rights. Therefore, the allegation is deemed UNSUBSTANTIATED. A finding that the complaint is unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation did or did not occur, therefore the allegation is unsubstantiated.

No deficiencies were cited per Title 22 Division 6 of the California Code of Regulations. An exit interview was conducted with facility administrator and a copy of this report was left at the facility.
