Licensing Program Analyst (LPA) Brian Balisi conducted an unannounced subsequent complaint visit to investigate the allegations listed above. Upon arrival LPA met with Administrator Belen Rodriguez and explained the reason for the visit.

On 02/25/2026, LPA conducted an initial 10-day complaint visit to investigate the allegations listed above. At approximately 10:00 a.m. LPA conducted physical plant, interviewed staff, residents, and reviewed and obtained copies of pertinent documentation relevant to the investigation. Today LPA conducted physical plant, interviewed staff, and reviewed and obtained copies of additional pertinent documentation relevant to the investigation. On 03/13/2026, LPA interviewed Tri-Counties Regional Center Enhanced CPP Service Coordinator (SC) Robert Zavala.
It was reported that "Staff denies resident additional servings of snacks" as it was alleged that clients are denied certain snacks when they request more. LPA's interviews with nine (9) staff reflected that six (6) staff stated they have never observed any staff restrict or deny a client an additional serving of snacks.

These six (6) staff also stated that they have always had access to snacks requested by clients Two (2) staff stated they did not have access to the full assortment of snacks and therefore were not able to provide certain snacks when clients requested a specific item. One (1) staff stated they have not personally observed staff restricting snacks, but reported that a client told them snacks had been restricted. During the physical plant inspection, LPA observed gallon-sized Ziploc bags labeled for each client containing a variety of snacks. LPA interviewed the Administrator, who stated that snacks are divided into daily “snack bags” to ensure each client receives a fair share of snacks for the day. The Administrator stated that if a client runs out of a specific snack from their snack bag, staff may offer a healthier alternative such as fruit, yogurt, or popcorn. However, if a client prefers a specific snack and it is available, staff will provide that item upon request. LPA observed multiple snack bags and additional boxes of snacks stored in the garage. LPA's interviewed with four (4) of the six (6) clients in care reflected that three (3) clients stated they have never observed staff restrict snacks and did not express any concerns regarding access to snacks. One (1) client stated that some staff have denied requests for additional snacks on multiple occasions. Two (2) clients were not available for interview. LPA's interview with Tri-Counties Service Coordinator Robert Zavala reflected that they did not express any concerns of snacks being distributed evenly in plastic bags for clients in care. Zavala also did not express any concerns for any staff restricting access to snacks for clients in care at this time. Based on the information obtained during the investigation, the Department does not have sufficient evidence to corroborate the allegation. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the above allegation, “Staff denies resident additional servings of snacks” is deemed Unsubstantiated at this time.

It was reported that "Staff speak inappropriately to residents in care" as it was alleged that staff speak to clients in a negative tone and at times disrespectful. LPA's interview nine (9) staff reflected that eight (8) staff have never observed any staff speaking to clients inappropriately. One (1) staff stated they have not personally observed any staff speak inappropriately to clients , but reported that a client informed them that they have had concerns with some staff. LPA interviewed four (4) of the six (6) clients in care. Three (3) clients stated they have never observed staff speak inappropriately to any clients and did not express any concerns regarding staff speaking inappropriately. One (1) client stated they felt that some staff have spoken to them inappropriately on multiple occasions. Two (2) clients were not available for interview. Based on the information obtained during the investigation, the Department does not have sufficient evidence to corroborate the allegation.

Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the above allegation, “"Staff speak inappropriately to residents in care” is deemed Unsubstantiated at this time.

It was reported that "Staff restrict access to personal items" as it was alleged that Client #1 (C1) does not have full access to their charger and Client #2 (C2) does not have full access to their clothes.
LPA's interview with nine (9) staff reflected that eight (8) staff stated that residents have full access to their personal belongings and that they have never observed staff restrict residents’ access to personal property. One (1) staff stated they observed C2's clothing stored in a locked room. LPA interviewed the Administrator and staff who primarily work with C2. They reported that C2 has demonstrated behaviors such as throwing clothing on the floor and moving newly folded clothing from their room to the dresser in a vacant room and back again. During the physical plant inspection, LPA observed a sufficient amount of clothing stored in C2’s closet, nightstand, and dresser. LPA also observed additional clothing belonging to C2 stored in a dresser located in a vacant room. The clothing in the vacant room was accessible to C2 during the visit. The Administrator reported that C2 has since been provided with a new dresser similar to the one located in the vacant room. LPA interviewed four (4) of the six (6) clients in care. Three (3) clients stated they always have access to their personal belongings and did not report concerns regarding staff restricting access. One (1) client stated that C1 must ask staff for the charger for their tablet. LPA interviewed C1 regarding this statement. C1 reported they were not concerned about access to the charger and stated staff always assist them with charging their tablet. Two (2) clients were not available for interview. Based on the information obtained during the investigation, the Department does not have sufficient evidence to corroborate the allegation. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the above allegation, “Staff restrict access to personal items” is deemed Unsubstantiated at this time.

It was reported that "Facility is not kept at a comfortable temperature" as it was alleged that the facility is too warm. LPA conducted interviews with nine (9) staff members. Seven (7) staff stated the temperature is always observed to be comfortable for clients in care.

Two (2) staff, have not personally observed the temperature to be too warm, but reported that a client has informed them in the past that they have felt it was too warm in their room at times. LPA interviewed four (4) of the six (6) clients in care. Three (3) clients stated they have always been comfortable with the temperature of the facility. One (1) client stated that their room gets too warm and has had to repeatedly asked staff to turn up the air conditioning. Two (2) clients were not available for interview. During physical plant LPA observed that the thermostat was set approx 4 degrees cooler than the temperature outside. Based on the information obtained during the investigation, the Department does not have sufficient evidence to corroborate the allegation. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the above allegation, “Facility is not kept at a comfortable temperature" is deemed Unsubstantiated at this time.
