The Administrator stated that if a client runs out of a specific snack from their snack bag, staff may offer a healthier alternative such as fruit, yogurt, or popcorn. However, if a client prefers a specific snack and it is available, staff will provide that item upon request. LPA observed multiple snack bags and additional boxes of snacks stored in the garage. LPA's interview with Tri-Counties Service Coordinator Robert Zavala reflected that they did not express any concerns of snacks being distributed evenly in plastic bags for clients in care. Zavala also did not express any concerns for any staff restricting access to snacks for clients in care at this time. Based on the information obtained during the investigation, the Department does not have sufficient evidence to corroborate the allegation. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the above allegation, “Staff denies resident additional servings of snacks” is deemed Unsubstantiated at this time.
