32 | On 04/20/22, licensee reported that the Oxnard Police Department came to the licensee’s home to investigate the allegation that Child #1 was injured while in care. C1’s parent stated that he picked up his child from daycare and observed 3 scratch marks on his left cheek which were not there when he dropped off. Regarding the recent scratches from 4/15/22, RP asked happened and according to RP the licensee stated that "she did not know" and "she didn't see it." RP filed a police report with the Oxnard Police Department as a result.
According the police report, licensee stated that stated that she believed that the scratches could have possibly been caused by her jacket zippers on the jacket she was wearing. RP stated that C1 had scratched the left side of his cheek earlier in the week. The mother had recently cut the baby's nails and then trimmed them again after the first incident and they had been placing gloves on the baby's hands to avoid any further scratching. Licensee interview also stated that around 4:40pm -4:50pm, close to pickup time, she went to feed the baby, change its diaper, and began burping the baby. She held the baby up to her left chest area and put a towel down so she could burp the baby. She stated that her jacket, which had a zipper, possibly scratched the baby on the left cheek. She was unaware of any scratches when she handed the baby over to the father, who was at the door in a line behind other parents who were picking up their child. Statements given to the officer are consistent to the ones she gave to LPA. The status of the police report is currently closed. Detective Morales from the Oxnard Police Department asserted that there was not enough evidence/information for a criminal investigation and therefore the case was closed.
Based on LPA's observations and interviews which reveal that the scratches could have possibly been from the licensee's jacket, the preponderance of evidence standard has been met, therefore the above allegation(s) is found to be SUBSTANTIATED. A Technical Advisory (LIC 9102) was given. Licensee was provided a copy of their appeal rights.
