On August 2, 2022 at 12:20 PM Licensing Program Analyst's (LPA's) Laura Villanueva and Susana Martinez conducted an unannounced Case Management- Other inspection. LPA's met with Director, Katherine Eclarinal and advised the reason for the inspection. Prior to entering the facility LPA's conducted COVID-19 screening questions, all answers indicate no COVID-19 related risks to be present.

During the LPA's tour with the director it was found that three staff: S1, S2, and S3 have not received criminal record clearance to work. LPA's asked S1 how long she has been working at the facility, S1 stated she started working 3 months ago. LPA's asked director how she determined that S1 was clear to work, director states facility received a livescan form dated 6/4/2022 stating the fingerprint request was received. LPA's asked director when S1, S2, and S3 started working at the center, director states S1's start date was 4/25/2022, S2's start date was 4/18/2022, and S3's start date was 5/31/2022. LPA's cross referenced Guardian to verify the status of criminal clearance and found; S1's process started in June with a status of not yet requested. S2 was cleared for adult care, but not child care. S3 had no record online. LPA's provided director with Guardian information to follow up on fingerprint clearance: guardian.dss.ca.gov and phone number 1-888-422-5669.

Director admits the three staff that do not have a criminal clearance also have incomplete personnel files. LPA's conducted staff file reviews of the three staff members and found S1 to be missing LIC 9108 and LIC 9052. S2 was missing LIC 9108, LIC 9052, immunization's, and CPR/ 1st Aid certification. S3 did not have a personnel folder present at the facility..

Today, 3 type A deficiencies and 3 type B deficiencies were cited under Title 22 Division 12. Appeal rights given.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.


Upon receipt of this report, licensee shall post and provide copies of this licensing report to parents /guardian of children in care at the facility and to parent/guardians of children newly enrolled at the facility during the next 12 months. Licensee to provide LIC 9224 for each child in care and have each parent sign the form that they have received a copy of the report LIC 809 and LIC 809 D.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

THIS REPORT MUST BE FILED IN FACILITY FILE AND MADE AVAILABLE FOR PUBLIC REVIEW FOR 3 YEARS.
