On 12/17/2024, Licensing Program Analyst (LPA) German Negrete conducted an unannounced inspection at Ventura Children’s Learning Center (CCC) to deliver the findings of the above-mentioned complaint allegation received by the department on 09/20/2024. LPA Negrete met with Director Viktoria , and LPA toured the center, both inside and out. LPA observed 5 staff providing care and supervision to 46 children.

The investigation included reviewing staff schedules, children's sign-in/out sheets, the staff handbook, and the parent handbook. LPA conducted parent interviews of current children, also interviewed the Director and staff. Additionally, LPA conducted four unannounced CCC inspections. LPA's observations during these inspections are included in the investigation.

Allegation #1: Facility Operating Out of Ratio

LPA interviewed multiple parents, most of whom stated they had not observed the facility providing care and supervision to children without having enough staff to supervise them (See LIC812).

LPA also reviewed the staff handbook, which provides guidance on page 8 regarding proper children-to-teacher/staff ratios as outlined by Title 22 California Code of Regulations (See LIC812).

LPA conducted staff interviews, which revealed that staff are familiar with the proper children-to-teacher ratio as outlined in Title 22. All staff who were interviewed acknowledged that the correct ratio is 12 children for every 1 teacher and 6 toddlers for every 1 teacher. Furthermore, all interviewed staff stated they have never observed the facility being out of ratio.

LPA also obtained and reviewed 90 days of children's sign-in/out sheets and staff schedules. When cross-referencing the staff schedules and children’s sign-in/out sheets, LPA did not find any days where the facility was out of ratio (See LIC812).

Allegation #2: Staff Commingling Day Care Children

LPA interviewed multiple parents, most of whom indicated that when they drop off or pick up their children, they have not observed a teacher caring for children while also caring for older or younger age group. Parent interviews revealed that most parents are satisfied with the level of care their children receive.

The Director also stated that the center complies with Title 22 regulations pertaining to commingling, and staff interviews confirmed the staff’s understanding of what commingling means. The staff who were interviewed are aware that commingling is not allowed under Title 22 California Code of Regulations. Continued on LIC9099-C

Additionally, the staff handbook/appendix references proper age groups for each program at the center, such as infants, preschoolers, and toddlers.

Furthermore, LPA conducted four facility inspections. During these visits, LPA did not observe any staff commingling children or any rooms where different age groups of children/infants were being commingled.

Allegation #3: CCC Punishing Children by Leaving Them in a Room with Younger Age Group Children.

LPA interviewed parents, and the interviews revealed that all parents who arrive at the center for pick-up and drop-off stated they never enter the CCC classrooms. Additionally, all parents stated they have not observed staff treating children inappropriately.

LPA conducted staff interviews, which revealed that staff are aware of the CCC policy they must follow when a child misbehaves. All staff interviewed stated they have never punished children in care by leaving them with a younger age group.

LPA reviewed the staff handbook, which states on page 15, "We (CCC) stress the importance of establishing positive relationships between teachers and children by using the following techniques to avoid and/or deal with problem behavior" (See LIC812). The staff handbook outlines 12 techniques that are intended to be used by staff to build positive relationships with children (See LIC812).

Allegation #4: CCC is Dirty, Unsanitary, and Unclean.

LPA received and reviewed cleaning invoices from the Director, which provide evidence of biweekly purchases to maintain the janitorial supply/inventory at a high level. LPA also received and reviewed transaction reports for janitorial services, maintenance, and other cleaning services. Furthermore, the Director provided a copy of the contract with the vendor (Coast House Cleaning), which outlines pricing, payment terms, the service provider's responsibilities, and other miscellaneous information.

As previously mentioned, LPA conducted four CCC inspections, and during these inspections, LPA did not observe the facility to be unsanitary.

Although the above allegations may have occurred or have some validity, there is not a preponderance of evidence to prove that the alleged violations did or did not occur. Therefore, the allegation is Unsubstantiated.
