On August 9, 2023 Licensing Program Analyst (LPA) Susana Martinez conducted an unannounced inspection to deliver the findings of the above mentioned allegations. LPA was grreted at the door by assistant Margarita Huerta. LPA advised assistant for the reason of the inspection. Assitant stated licensee was out picking up children from summer camp. At the time of the inspection there were 6 napping children and no other adults in the home. Licensee Yuliana Perez arrived and LPA advised her of the purpose for the inspection. Together with the licensee, LPA toured the home inside and outside.

The Department received an allegation stating licensee will not let parents into the day care. On 5/23/2023 LPA Martinez initiated the complaint and conducted an interview with the licensee and staff present. LPA conducted file review, staff and parent interviews. Parents who were interviewed indicated that the licensee allows parents to step inside the home at pick up and/or drop off. No parent indicating ever being denied access into the home. While initiating the complaint, LPA observed several parents enter the home without issues.

Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.

Together with the licensee, LPA toured the home inside and outside.

The Department received an allegation stating Licensee is making modifications to the day-care while children are in care and did not notify licensing. On 5/23/2023 LPA Martinez initiated the complaint, upon arrival to the home, LPA observed the kitchen to be under full construction. LPA conducted interviews with Licensee, staff and parents. LPA asked Licensee what was happening in the kitchen, Licensee stated the water pipe had broken down the day prior to 5/23/23. LPA asked if she had contacted the Department to make us aware of the situation. Licensee stated not yet.

Licensee closed the facility while construction was being conducted. Licensee is to submit a written statement as to how she plans to prevent this deficiency from occurring in the future. Written statement is due to the Department by 8/23/2023.

Based on LPA’s observation, interviews conducted, and record review, Licensee did not comply with the deficiency cited above as the Department was not made aware of the construction/remodeling occurring during operational hours which poses a potential risk to the health, safety and or personal rights of children in care.

LPA interviewed staff members whom indicated the construction/remodeling had started the week prior and had been going on for more than 2 days. One staff member shared that the Licensee had previously done other remodeling in the home during operational hours.

Based on LPAs observations, interviews which were conducted, documents gathered and record review, the preponderance of evidence standard has been met, therefore the above allegation is found SUBSTANTIATED.

The following deficiencies are being cited in accordance to Title 22 of the California Code of Regulations and/or Health & Safety codes. Please refer to LIC9099D for documentation of deficiencies cited: 102416.3 Alterations to Existing Buildings or Grounds (a)(6)



A notice of site visit was given and must remain posted for 30 days.

Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

A copy of the Appeal Rights (LIC 9058 FAS 01/16) were given and explained. Licensee’s signature on this form acknowledges receipt of these rights.
