On March 9, 2023 at 11:30 AM Licensing Program Analyst (LPA) Laura Villanueva made an unannounced inspection to initiate the investigation for the above allegations. LPA met with Director, Anne Rose and explained the purpose of the inspection. LPA asked pre-screening questions related to COVID-19 responses suggest no COVID exposure on site. LPA conducted a tour of the facility inside and outside. LPA observed a total of 81 children under the care and supervision of 8 staff. Director and Assistant Director were in the ratio due to not enough staff.

While conducting the tour of the facility, LPA observed 12 toddlers in the toddler room. The capacity on the child care license is for preschool children aged 2-6 with a toddler option for 18-30 months not to exceed 10 toddlers for a total capacity of 130 children. The toddler option is over capacity 2 children. LPA interviewed staff and found that they are over ratio in the morning when staff is arriving and in the afternoon when staff are

leaving. The children are combined in the playground for a few minutes until proper staffing is put in to place. The Director and Assistant Director are in the classroom due to lack of staff. Based on LPA observation, interviews conducted with staff and documentation, the preponderance of evidence standard has been met. Therefore, the above allegation is found to be SUBSTANTIATED. LPA issued citations for over capacity and limited supervision due to center not adhering to limitations on child care license. Two type A violations were issued in section Limitations in capacity 101161(a) and Responsibility for care and supervision 101229(a)(1). Today, deficiencies cited under Title 22 Division 12. Appeal rights given.

A copy of this report must be provided to the authorized representatives of all currently enrolled children and must also be provided to newly enrolled children for the next 12 months. The report shall be provided no later than the next business day or the next day the child is in care.

Copies of this report must be posted for 30 days in a visible location for the authorized representatives of children. Notice of Site Visit has been posted (LIC9213). The notice shall be posted for 30 consecutive days. Failure to maintain posting as required will result in a $100.00 civil penalty.

Exit interview conducted with Director. A copy of the Appeal Rights (LIC 9058 FAS 01/16) were given and explained. Director's signature on this form acknowledges receipt of these rights.

Due to the child care center being over capacity based on their child care license, children can not be supervised accordingly. The child care will adhere to license capacity to effectively supervise children.
