On April 29, 2024 at 11:40 AM, Licensing Program Analysts (LPAs) Susana Martinez and Aaliyah Zendejas conducted an annual / random visit at the above mentioned facility. LPAs met with the licensee's assistant, who identified herself as Itzel Feregino and advised them of the purpose of the inspection to which the assistant stated that the licensee was out at an appointment. There were 3 children in care at the time of the inspection.

LPA observed required licensing documents mounted on the walls at the front entrance of the home. Fire and earthquake drills are not being documented every six months. Fire extinguisher 2A10BC mounted on the wall near the kitchen but did not have a service ticket or receipt attached. LPAs asked for proof of purchase which was 1/21/2024 and verified via a virtual receipt. Fire and carbon monoxide detectors were not tested because a child in care was asleep.

Children in care have access to one room, one restroom, kitchen, living room, and enclosed back yard. Kitchen knives were observed to be placed out of reach of children and there were no toxins found underneath the kitchen sink. Children have access to toys that are age-appropriate inside and outside of the home. Back yard play area is enclosed and has plenty of appropriate objects for children to play with. LPA observed that licensee does not have any guns or ammunition. During the tour, LPA did not observe any hazards/toxins items accessible to children in care.

At 11:44 AM, LPAs observed an infant sleeping in a crib with several items within the crib such as blankets, a pillow, and a stuffed animal. LPA asked assistant if they had been documenting the 15 minute checks and they stated that they had the paperwork somewhere. At 12:14PM, LPAs asked to review the paperwork for the safe sleep checks and assistant stated that they had not been documenting for the day. At 11:47 AM, LPAs noticed that the stairs did not have a gate in front of them, thus making them accessible to children in care. Con'd on 809-C

LPAs went upstairs and looked through the rooms that were open and accessible to children in care. LPAs found nothing harmful or any toxins readily available and advised assistant that they should be leaving the gate in front of the stairs so children do not have access to the upper level.

LPA reviewed three children files. All children files were current and filled out thoroughly. Licensee CPR/first aid is valid through 01/26/2026. Licensee's mandated reporter training is valid through December 6, 2025. Licensee was reminded that as a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter certification AB1207 every two years at www.mandatedreporterca.com.

During file review, LPAs observed TB and immunizations to be missing from assistant Itzel's records. LPAs then discovered that assistants actual name is Fanny Sudia, who has a criminal record clearance on file. LPAs verified mandated reporter training under the assistant's real name. Immunizations, TB clearance and CPR/First Aid are missing. Assistant Fanny stated she conducted the CPR/First Aid training in 11/2023.

LPAs observed a prohibited item readily available while touring the facility. The item was a saucer chair that was seen in an area that is accessible for children in care.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Licensee advised there were no children in care that required Incidental Medical Services. Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. LPAs provided the following resources:
- A pictorial handout of items not permitted in a licensed facility.
- FAQs regarding safe sleep
- Disaster Drill Log

During today's inspection One (1) Type A and Five (5) Type B deficiencies were issued and found on the attached 809-D's.

Also, LPA's informed the assistant, Fanny Sudia to provide a copy of this licensing report dated 04/29/2024 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

A notice of site visit was given and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days.

Exit interview conducted and report was reviewed in Spanish with the assistant Fanny Sudia.
