On February 10th, 2025 Licensing Program Analysts (LPAs) Rosie Breault and Fernando Hernandez conducted an announced pre-licensing inspection at the above forementioned facility to ensure that health, safety, and personal rights as requires by Title 22 and Health and Safety Regulations governing California Child Care Centers will be met. There were 150 children present during this inspection. A change of ownership application was submitted for preschool license # 566215196 and infant license # 566215214 which results in a single license conversion. Applicant has requested to care for 20 infants aged 0-24 months, 24 toddlers aged 18 months to 36 months, and 201 preschoolers aged 3 years to 6 years, for a total requested capacity of 245 children. This facility is on the grounds of Phoenix Ranch Elementary School and hours of operation are M-F 7:00AM-6:00PM

LPAs met with director Leah Pohlman and assistant director Stephanie Carver. During the course of the inspection, Ms. Pohlman had to leave inspection and left report authority to Ms. Carver. Assistant director and LPAs together toured the facility. LPAs observed regulation postings placed in a prominent location, and facility utilized ProCare app for the purposes of signing in and out. LPAs inspected and measured the on-limits areas and classrooms located at the facility. Facility maintains a total of 22 sinks and 19 toilets available for children. LPAs observed one additional toilet and sink separate from the number of toilets and sinks, designated for use by children who are ill, for use by staff, and for emergency use. Carbon monoxide tested and functioning at the time of the inspection, first aid kits available, and fire extinguisher last serviced on 6/12/2024.

The facility utilizes a total of 10 classrooms for care and supervision. Infants using room #15, toddlers using room #14, preschoolers using rooms #1-#8.

In the infant room, LPAs observed the floors to have a surface that is safe and clean, with protective devices including but not limited to nonslip material on rugs. LPAs observed the crib area for infants physically separate from the indoor activity by a transparent sound absorbing barrier 4 feet in height. LPA advised director facility must adhere to Safe Sleep regulations at all times including 15-minute checks to be conducted and recorded. LPAs observed changing table has a padded surface no less than one-inch thick and covered with washable vinyl or plastic and changing table is located within arm’s reach of a sink. Poisons, toxins, cleaning supplies are stored elevated and locked. LPAs observed a variety of age-appropriate washable toys, soft play items, and equipment for use.

In the toddler room, LPAs observed a variety of age-appropriate toys and equipment to meet the needs of children. LPAs observed individual storage “cubbies” for children’s personal items. Drinking water is available and children also bring personal water bottles. At the time of the inspection, LPAs observed toys to be free of loose or pointed edges, and furniture to be in good condition. Children rest on cots and LPAs advised director must adhere to Safe Sleep regulations including 15-minute checks (conducted and recorded) for all sleeping infants up to age of 24 months.

In preschool rooms, LPAs observed a variety of age-appropriate equipment, toys, and materials in good condition and in sufficient quantity to allow children present to fully participate in planned activities. LPAs observed individual storage “cubbies” for children’s personal items. Children use cots for napping and personal bedding is stored separately from one another. Drinking water is available and children also bring personal water bottles. Toxins, cleaning supplies are stored elevated and locked.

LPAs advised facility to remain in good repair at all times to ensure the safety and well-being of children, employees, and visitors.

Ventura County Fire Department cleared facility on 08/27/2024. Per applicant, no firearms, or ammunition are present on the property.

Outdoor area consists of one large play yard divided into three sections for each age component to prevent co-mingling of children.

Infant yard contains a variety of soft toys, soft padding to absorb falls, and sufficient shade. Toddler yard contains soft padding, age-appropriate equipment, and a variety of toys to meet the needs of children. Preschool yard contains, ample shade, availability to water, sandbox free of debris, and glass, tricycles for riding, and soft padding.

Two swimming pools are located on the premises of the facility, which are used by both preschool and elementary children. LPAs with assistant director, inspected, measured, and noted equipment and features to ensure pool safety compliance. The swimming pools are located in the rear back area of the preschool play yard. At the time of the inspection LPAs observed the following:

· Perimeter fencing is 60 inches and constructed so that the fence does not obscure the pools from view.

· There are two gated entrances to the pool.

· A maximum vertical clearance of two inches from the ground to the bottom of the enclosure is present.

· No gaps or voids that can allow the passage of a sphere with a diameter equal to or greater than four inches were present.

· Outside surface is surrounded by cement footholds that could enable a child to climb over. In addition, to the back left rear of pool, LPAs observed the foothold adjacent a small wall which a child could potentially climb to enter pool.

· At the time of the inspection, LPAs confirmed applicant has the following safety equipment visible from the swimming pool and readily available for immediate use:

1. A life ring with a minimum exterior diameter of 17 inches with a United States Coast Guard approval label.

2. A rescue pole with a body hook and a minimum fixed length of 12 feet.

LPA’s reminded applicant that an inspection log of the drowning prevention safety features and equipment must be conducted and recorded daily prior to opening the facility and must be provided to the Department upon request. LPAs reminded applicant must maintain compliance with Department’s Health and Safety Code Regulations and AB 2866 regarding safe pool use at all times.

Drinking water from a noncontaminating fixture or container shall be readily available both indoors and in the outdoor activity area. LPA advised per Health and Safety Code 1597.16(a)(1) Lead Testing and PIN-21-21-CCP Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010 to test their drinking water for lead contamination between January 1, 2020 and January 1, 2023, and then every 5 years after the date of the first test.

Per Written Directive 100700(c)(1) Written Directives for Lead Testing (1) For a license issued on or after July 1, 2022, initial testing results shall be received and posted within 180 days of licensure.

This facility plans to provide Incidental Medical Services – IMS. For IMS information, see Evaluator Manual - Regulation Interpretations and Procedures for Child Care Centers Sections 101173 and 101226. A Plan of Operation that includes IMS must be submitted to the Department. Co-director was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5-days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated.

Applicant was informed of the MyChildCarePlan.org site, a consumer education website that helps families obtain childcare by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

Community Care Licensing Division (CCLD) regularly sends information to licensed facilities, providers, and stakeholders by way of Provider Information Notices (PIN), Program Quarterly Update Newsletters and other important information communication platforms.

License pending following corrections and approval:

Both gates to swing away from the pool and have self-closing with a self-latching key lockable device placed no lower than 60 inches from the ground.

Pool covers present either manually or power operated and meets the standards of the American Society for Testing and Materials (ASTM) and are strong enough to completely support the weight of an adult OR Pool alarms installed, that when placed in a swimming pool, the sound will detect an entrance into the water.

Permitter foot holding to be gated, blocked, or rendered inaccessible to children.

Lifeguard CPR for staff members.
