Facility's staff physically forcing a child to sleep during nap time

Licensing Program Analyst (LPA) Erwin Tjhia met with Director, Lauren Garcia to deliver findings of the complaint investigation regarding the above allegations. There were 19 children and 2 staff during the visit.

Throughout the investigation, LPA reviewed the documentation pertinent to the investigation, conducted
observation, and interview. It was alleged that Facility's staff physically forcing a child to sleep during nap time. LPA was unable to determine if children were forced to nap based on unclear evidence that was received. Moreover, LPA received contradicting statements during the interviews as some staff stated that the children were never physically forced to sleep , while other disagree and says it happened in the classroom. Furthermore, during the visit at the facility, LPA observed teachers gently pat/rub children’s back as the children were trying to sleep. LPA also saw some children were awake and laying quietly on their cot with books. The children interview reveal that the teachers are nice and gentle when helping them to sleep during the nap time.

Therefore, the above allegations are found to be Unsubstantiated, meaning although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur.
