On 10/13/2023 at 9:20 AM Licensing Program Analyst (LPA) Susan Brewer, arrived unannounced at the facility to conduct a 1 year required annual inspection for the Preschool Program. LPA was granted entry by Director Diana Ramirez, LPA toured the facility, inside and out, reviewed records, and observed and/or discussed the following:

Normal days and hours of operation are: Monday- Friday, 6:00 AM to 6:30 PM, In the Discovery Room and Preschool Room. A waiver is on file for shared outdoor play area with the school age program on a rotating schedule, which requires an update. A 2nd waiver is required for the commingling during the 1st and last hour of operation with the school age program.

The inspection consisted of reviews of the following domains: Food Service; Reporting Requirements
Physical Plant; Care and Supervision; Children Records; Staff Records; Staffing Ratio and Capacity and
Personal Rights. The inspection found the facility to be in compliance in these domains, except as noted on the LIC809D. The licensee is asked to update the following documents, if applicable, and submit to licensing within 30 days on or before 11/23/2023:

1. LIC 500 Personnel Report, update requested.
2. LIC 610 Emergency & Disaster Plan, update requested.
3. Parent Handbook/ Program Curriculum/Admission policies and procedures/ fee schedule (only if changes have been made), update requested.
4. LIC 309 Administrative Organization
5. LIC 308 Designation of Administrative Responsibility
6. Waiver request to Share the Outdoor Playground with School Age Children

The following items have been posted and are updated where necessary:
License, Emergency Disaster Plan (LIC610) and Earthquake Preparedness Checklist (LIC9148)
Parent’s Rights Poster (PUB393), Personal Rights (LIC613A); Child Car Seat Law, Menu.
· The facility is NOT operating within the terms of the license. By the licensee's own admission, the licensee was commingling an infant child 7 days prior to their 2nd birthday, as a way of transitioning the child and without a request submitted to Community Care Licensing for an exception, a waiver or notification of a new plan of operation.
· Ratios were met and appropriate supervision was provided during this inspection. LPA took a census of 34 children in care of 8 staff, however the census included 1 child transitioning from the infant program under 2 years old.
· Classrooms are clean, free of hazards and equipped with age-appropriate furniture are in good condition.
· No weapons stored at the facility on 10/23/2023.
· There are no accessible bodies of water present on 10/23/2023. All wading pools or similar product must be emptied immediately after use and stored in an upright position.
· Medications are stored where inaccessible to children in the facility kitchen. The kitchen door has a key lock on doorknob to gain access. Inside the kitchen is a medicine cabinet which is locked and mounted high on the wall. No incidental medical services are being provided to preschool children on 10/23/2023.
· Hazards are stored where inaccessible to children which include: Disinfectants, cleaners and other items that are dangerous. Poisons and toxins are locked in the facility storage room.
· All floors are clean and safe.
· Bathrooms were observed to be safe, sanitary and in operating condition, with the exception of one child sized sink which was not operable. During the inspection, LPA S. Brewer observed one child sized sink located next to the 3 toilets in the preschool restroom was observed to broken and not operating. The preschool room has 3 alternative sinks available for handwashing.
· Outdoor activity areas/playgrounds are enclosed by appropriate fences and are supplied with age and size appropriate equipment in good condition. However, during the inspection of the outdoor activity area LPA S. Brewer, observed the black top to have large cracks in the surface caused by the growth of a roots from a large shade tree, which are a potential hazard. The facility has a waiver on file to share the playgrounds, which will need to be updated with a new name.
· Food preparation area is clean, free of litter, rubbish and free of rodents and other vermin.
· Measures are taken to keep the facility free of flies, other insects and rodents.

· Food is not stored appropriately and protected from contamination. LPA observed an open bag of cheerios in a storage bin, that was not properly stored. LPA observed a bowl of frozen chicken tenders in a large freezer, which had saran wrap however the wrap was loose and openly exposed the frozen food items making it uncovered.
· Storage containers for solid waste, including moveable bins-have tight-fitting covers in good repair.
· Menus are posted at least one week in advance in a place visible by the child’s authorized representative, dated and kept on file for 30 days, and made available upon request.
· Uncontaminated drinking water shall be readily available both indoors and out and provided by tap water, igloo jugs, sippy cups, water fountains and disposable cups.
· The areas around or under high climbing equipment, slides, and similar equipment shall be cushioned with material that absorbs a fall. LPA observed the blacktop surface to be raised and cracked by the growth of large tree roots, which is a potential tripping hazard. In addition, although the artificial rubber turf installed was observed to have some padding underneath that provided a bounce, however, the material was hard as a rock and rough to the touch due to the wear and tear.
· Sign in/Sign out record was reviewed and meets regulation requirements.
· A Staff member is NOT present with proof of current Pediatric CPR/First Aid training. The director and assistant director CPR/1ST Aid Training expired.
· Opening and closing staff members participated in online only CPR/First Aid training, which are not EMSA approved. In addition, the 3 staff members assigned to transport children to and from school did not have proof of the CPR/1ST Aid training.
· Director completed Health and Safety Training on 04/27/2023.
· Staff qualifications and files were reviewed and are NOT complete. The facility failed to have an employee present with proof of current and/or valid CPR/1st Aid training, to include the 3 employees assigned to transport daycare children to and from the facility, 1 employee is missing, proof of Measles and Pertussis, 2 employees were missing proof of the California Child Abuse Mandated Reporter Training.
· A review of staff records on 10/18/2023 indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.
· Staff have received on the job training for housekeeping, sanitation and universal health precautions
· Licensee was informed the Department has inspection authority per Health and Safety Codes.

· Documentation of fire & earthquake drills to be conducted every six months: Last drill on 09/15/2023.
· Documentation of Lead Test: Completed on 11/23/2022, with no Action Lead Exceedances.
· AB2370 – Lead Exposure, day care facilities, effective January 1, 2019 – The bill requires that all Child Care Centers, operating in a building constructed before January 1, 2010, shall have their drinking water tested for excessive lead levels, on or after January 1, 2020, but no later than January 1, 2023. Child Care Centers must thereafter test their drinking water every five years after the date of the initial test.

· AB2960 – Child care and development services, online portal – Effective June 20, 2022 - This bill requires the State Superintendent of Public Instruction (SSPI), within the California Department of Education (CDE), to develop and post on CDE's website a comprehensive child care and development services online portal for families and providers by June 30, 2022.

This facility provides Incidental Medical Services – IMS. LPA reviewed storage of medication and equipment/supplies, and reviewed children’s, personnel, and administrative records however there were no preschool children receiving IMS services at this time. Facility Representative was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.
