32 | On 4/25/25, Director Roxan Tutelian provided documentation for staff qualifications including transcripts and proof of work experience. An additional review of the documentations provided indicated that the staff present on 4/11/25, S4, S7, S10, S12, S15, S17 and S19 meet the regulatory requirements for a fully qualified teacher and S5, S8, S13, S16, and S18 meet the regulatory requirements for a qualified aide. Some staff members have taken or is enrolled in CHDEV or ECE courses; however, the course(s) did not meet the educational requirements per the department's regulation. The remaining staff S1, S2, S3, S6, S9, S11 and S14 did not meet regulatory requirements for a qualified teacher or aide.
Due to the additional records review conducted, it was determined that an error was made in the previous LIC9099 report. The above reflects an updated list of 3 additional qualified teachers and 1 qualified aide; therefore, civil penalties assessed during a Case Management – Plan of Correction (POC) inspection conducted on 06/09/2025 in the total amount of $3,400.00 are not warranted and has been rescinded.
LPA informed Director Roxan Tutelian even with the 3 additional qualified teachers and 1 qualified aide, 4 out of 6 classrooms are still operating out of ratio on 04/11/2025 and this was due to unqualified staff providing care and supervision to children in care. The preponderance of evidence standards has been met; therefore, these allegations are deemed to be SUBSTANTIATED.
LPA reviewed the Department’s regulations regarding 101216.1 - teacher qualifications, 101216.2 - teacher-aide qualifications, and 101216.3 - teacher-child ratio with Director Roxan and was provided printouts. Director stated she understood.
Per California Code of Regulations, Title 22, Division 12, Chapter 1, the following deficiencies are cited on the attached LIC 9099D).
LPA Pa Kou Vue informed Director Roxan Tutelian that this report dated 05/23/2025 documents two Type A citations which shall be posted for 30 consecutive days as there are immediate risks to the health, safety, or personal rights of children in care. Also, LPA Pa Kou Vue informed Director to provide a copy of this licensing report dated 05/23/2025 that documents any Type A citations to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
A copy of the Fact Sheet - Child Care Parent Notification Requirements and a copy of LIC 9224 Acknowledgement of Receipt of Licensing Reports was given to Director Roxan Tutelian.
An exit interview conducted with Director Roxan Tutelian. A copy of this report and Appeal Rights were provided and discussed. A Notice of Site Visit Form was posted to parent's board and must remain posted for 30 days.
