This report was amended to include additional information on March 10, 2025. On February 4, 2025, Licensing Program Analyst (LPA) Carol Heath conducted a follow-up complaint visit to Tinoco, Trinidad Family Childcare Home. Upon arrival, the licensee answered the door and granted LPA access to the facility. The purpose of the inspection was to amended the report and interview children.During the visit, LPA observed four children in care—one infant and three toddlers—under the supervision of the licensee and an assistant.
As part of the investigation, LPA Heath interviewed the licensee, assistant, and other relevant individuals. Documentation obtained from R&R confirmed that over 44 children were enrolled, with many not listed on the facility roster. During the visit on 02/03/2025, the licensee admitted to LPA that the facility exceeded the limit of 14 children at one time. The licensee explained that she needed additional income to support her family and apologized for not adhering to regulations.
Based on record reviews and the licensee’s statements, there is a preponderance of evidence to prove that the facility was over capacity. Therefore, the above allegation is Substantiated.
Appeal Rights were provided and reviewed with the licensee, and deficiencies were cited accordingly.
An exit interview was conducted, and the report was reviewed with the licensee, Trinidad Tinoco.

The licensee admitted that she occasionally had 17–18 children in her facility. She understands that she is only allowed to have a maximum of 14 children during operating hours.

The LPA examined records and conducted interviews with relevant parties. The licensee's facility has over 44 children enrolled, some attending only AM or PM sessions. However, many children remain on-site from after school until their parents arrive in the evening, which poses an immediate health, safety, or personal rights risk to persons in care.

The licensee agreed to a meeting at the Regional Office (RO). The Licensing Program Analyst (LPA) will contact her to schedule the appointment.
