32 | LPA discussed with Interim Director, the definition of supervision and how the facility continues to maintain supervision at all time. No disclosures regarding the allegation were made.
During Staff interviews, it was disclosed by Staff #4 (S4) and Staff #5 (S5) that an incident took place where Child #1 (C1) and Child #2 (C2) were left in the back playground alone. A staff member was conducting a tour on 05/08/2023 around 10-11am, and had observed there were two children without any adult supervision in the outdoor play area behind Cottage Rooms 1 and 2. They were by the swing set. When children were asked by the staff, they confirmed that they were alone and that there were no staff with them. S4 then brought the children back to the appropriate group they were assigned to. Staff were unaware of the children from their group had been left behind in another area during transition time.
This agency has investigated the complaint alleging that there was a violation of Title 22, Division 12, Chapter 1, Article 6, Section 101229 "Responsibility for Providing Care and Supervision.” The complaint alleged that “Staff left children unsupervised on playground." Based upon the evidence as presented above, the allegation has been determined to be Substantiated. A finding of Substantiated means that the preponderance of evidence standard has been met. California Code of Regulations, Title 22, Division 12, Chapter 1, Article 06, Section 101229 "Responsibility for Providing Care and Supervision” is being cited on the attached LIC 9099D.

A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled children for the next 12 months (1 year). The Acknowledgement form must be maintained in each child’s file immediately upon receipt from parent. Licensee/Director was provided with a copy of the parent Acknowledgement of Receipt of Licensing Reports Form during this visit. A copy of the Parent Notification Requirements was also provided to the Director
The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site visit by a licensing representative.
Exit interview was conducted with Interim Director Evie Escatiola, at 1pm and Plan of Corrections were reviewed and developed. Copy of Report provided.
