Ana Chico, Licensing Program Analyst (LPA) conducted an unannounced complaint inspection. Met with Uma Chander,licensee. LPA advised Ms. Chander that complaint finding would be provided on today's date.

Personal Rights: LPA conducted child and staff interviews. LPA was also provided with written declarations. During the course of the investigation, LPA found that in December of 2017 Staff #4 was informed about a possible issue at the school. Interviews and statements obtained found that Staff #4 yelled at children who alleged that the incident was occuring at the school. LPA found that the manner in which Staff #4 handled the concern was a direct violation of personal rights.

Based on the evidence as stated above, the preponderance of evidence standard has been met. Therefore, the allegation of ""Personal Rights"" is found to be substantiated. A finding of Substantiated means that the allegation has been found to be valid because the preponderance of the evidence standard has been met. A Type A citation has been cited in accordance to Title 22, Division 12, Chapter 1, Article 6, Section 101223 See attached LIC 9099D. Report continues on LIC 9099C ......

Ana Chico, Licensing Program Analyst (LPA) conducted an unannounced complaint inspection. Met with Uma Chander,licensee. LPA advised Ms. Chander that complaint findings would be provided on today's date.

Care and Supervision: Based on interviews conducted with complainant, staff and children, LPA found that there were no other witness to support the allegation that staff failed to provide adequate supervision when subject of the investigation was kicked by another child. According to complainant the only person she notified at the time of the incident was a previous director who was employed briefly at the facility. In addition, there were inconsistent statements about the alleged incident which also resulted in a broken computer. Therefore, though the incident may have occurred there is insufficient evidence that staff could or could not have prevented the child from being kicked due to inconsistent statements.
This agency has investigated the complaint alleging that there was a violation of Title 22, Division 12, Chapter 1, Article 6, Section 101212 "Lack of Care and Supervision" Based upon the evidence as listed above, it has been determined that the complaint was Unsubstantiated. A finding of Unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur. Personal Rights: LPA conducted interviews with children, complainant and staff. Interviews found that prior to complaint, school age staff had not been notified or had witnessed children being "bullied". According to Staff #3 a concern regarding subject child being bullied was brought to her attention in December. Staff stated that she did not observe child being "bullied" at the school but acknowledged that subject child's sister and two other participants did in fact call subject of the investigation "diabetic boy". Per staff #3 she spoke to subject child's sister about her behavior and also spoke to the other two participants. Staff #3 stated that the concern was brought up to Staff #4. Staff #3 also stated that she had never heard or observe subject child being kicked by other children at the center.
Staff #4 also denies that there was a "bullying" problem at school. Staff #4 states that the concern regarding bullying was first heard in December. Staff #4 also states that he had never heard or witnessed subject child get kicked. Therefore, though there was a concern regarding child being called "diabetic boy" which did in fact occur, there is insufficient evidence to support the allegation that there was a "bullying" problem which staff allowed to manifest or failed to address.

This agency has investigated the complaint alleging that there was a violation of Title 22, Division 12, Chapter 1, Article 6, Section 101223 "Personal Rights" Based upon the evidence as listed above, it has been determined that the complaint was Unsubstantiated. A finding of Unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur.

Exit interview was conducted with licensee. No deficiencies cited. Appeal rights provided. Notice of Site Visit to be posted for 30 days.

Personal Rights. Each child shall be accorded dignity in his/her personal relationships with staff, and other persons.

Children's personal rights were violated when Staff #4 yelled at children during the questioning of an alleged incident.

Per licensee she will look into having staff attend a workshop or classes that focuses on managing issues in the facility and will also provide training via department website on Personal Rights. A sign in sheet as proof of attendance will be forwarded.

Upon receipt, the Licensee shall post the Notice of Site Visit and the Licensing report. This report and the Notice of Site Visit shall be posted for thirty (30) consecutive days. Failure to maintain posting as required will result in a $100 civil penalty. A copy of this report shall be provided to the parents/guardians of the children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parents/guardians of any children newly enrolled at the facility for the next 12 months. The LIC 9224 Acknowledgement of Receipt of Licensing Reports must be maintained in each child's file immediately upon receipt from the parent. Exit interview conducted with licensee.
