|Ana Chico, Licensing Program Analyst (LPA) conducted an unannounced complaint inspection. Met with Uma Chander,licensee. LPA advised Ms. Chander that complaint findings would be provided on today's date. |
Care and Supervision: Based on interviews conducted with complainant, staff and children, LPA found that there were no other witness to support the allegation that staff failed to provide adequate supervision when subject of the investigation was kicked by another child. According to complainant the only person she notified at the time of the incident was a previous director who was employed briefly at the facility. In addition, there were inconsistent statements about the alleged incident which also resulted in a broken computer. Therefore, though the incident may have occurred there is insufficient evidence that staff could or could not have prevented the child from being kicked due to inconsistent statements.
This agency has investigated the complaint alleging that there was a violation of Title 22, Division 12, Chapter 1, Article 6, Section 101212 "Lack of Care and Supervision" Based upon the evidence as listed above, it has been determined that the complaint was Unsubstantiated. A finding of Unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur.
