On 09/13/2022 at 9:10 a.m. Licensing Program Analysts (LPAs) Deborah Lowe and Judy Laureano met with Preschool Director, Chaya Rotenberg. The purpose of the visit was an announce case management – licensee-initiated inspection at the facility to ensure that health, safety and personal rights as requires by Title 22 and Health and Safety Regulations governing California Child Care Centers will be met. There were 28 children were present with 7 staff during this inspection. This is a capacity increase application for 115 children, ages 2 years to 5 years old. The child care center will operate Monday – Thursday 8:05 a.m. – 4:00 p.m. and Friday 8:05 a.m. – 1:00 p.m. The fire clearance was approved on 08/03/2022.

Facility is located on the corner of La Cienega Blvd and Packard St., facility also serves elementary school and middle school children with an age range of 6 years old to 14 years old. Preschool children and elementary/ middle school children do not commingle. Facility was observed with an armed guard stationed on the sidewalk outside of the facility entrance.

LPAs Lowe and Laureano toured and measured the on-limits areas and classrooms located at the facility. The facility is requesting to use a total of 6 classrooms. Rooms to be used for care and supervision of preschool children first floor rooms #4, #5, #6, and #7, 2nd floor classrooms rooms #1 and #3. On the 2nd floor room #2 and library are off limits to preschool children. Room #2 was observed to be set up as an adult conference room, the room was not set up to be used for children. Children will have access to 11 sinks and 8 toilets.

Classroom measurements are:

Indoor total measurements: 3,334.09 square (sq) feet (ft) divided by 35 sq ft = 95 children.

Application requested capacity is 115.

Outdoor Play measurements are:

Outdoor total measurements for preschool outdoor play area: 2547.17 sq ft divided by 75 sq ft = 33 children.

Facility has a 2nd outdoor space currently used for elementary and middle school children. LPAs measured space as licensee may possibly request a waiver for shared outdoor space with no commingling. Additional outdoor play area measurements: 5,410.08 sq ft divided by 75 sq ft = 72 children.

Indoor/Children’s Area:

In rooms 1, 3, 5, 6, and 7 Indoor passageways, stairways, inclines, and other areas of potential hazard were observed to be free of obstruction. In room 4, indoor passageway to an outside exit door was observed to be obstructed by cots and a shelf. LPAs advised per regulation 101238(c) All outdoor and indoor passageways, stairways, inclines, ramps, open porches and other areas of potential hazard are kept free of obstruction. The child care center was observed be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors. Floors of all rooms have a surface that is safe and clean. A comfortable temperature for children was observed to be maintained at all times. Furniture and equipment were observed to be maintained in good condition, free of sharp, loose or pointed parts. Tables and chairs were observed to be meet the needs of the children. All play equipment and materials used by children were observed to be age-appropriate. LPAs observed that each child has an individual permanent or portable storage space for his/her clothing, personal belongings and/or bedding. All materials and surfaces accessible to children, including toys, were observed to be free of toxic substances.

Drinking water from a water filter system is readily available both indoors and in the outdoor activity area. The facility uses a monthly pest control service to assist in taking measures to keep the center free of flies, other insects, and rodents. All containers used for storage of solid wastes, including moveable bins, were observed to have a tightfitting cover that is kept on; in good repair; and leakproof and rodent-proof. No Fireplaces and open-faced heaters were observed at facility. Window screen in room 3 was observed with a hole in the screen. LPAs advised per regulation 101239(b) All window screens shall be in good repair and free of insects, dirt and debris.

LPAs advised per regulation 101238(g) Disinfectants, cleaning solutions, poisons and other items that could pose a danger if readily available to children shall be stored where inaccessible to children. LPAs advised storage areas for poisons shall be locked. No poisons were observed during visit. LPAs observed a current edition of a first-aid manual, sterile first-aid dressings, bandages or roller bandages, adhesive tape, scissors, tweezers, thermometer, and antiseptic solution.

Director stated isolation area will located in the directors office near room #4. LPAs advised if isolation is moved, the isolation area shall be located to afford easy supervision of children by center staff. LPAs advised the isolation area shall be equipped with a mat, cot, couch or bed for each ill child. The isolation area shall not be located in the kitchen area or the general-use toilet area.

LPAs observed 4 carbon monoxide detectors in the facility, 2 on the 1st floor and 2 on the 2nd floor. LPAs were able to hear a successful test of the carbon monoxide detector near the office and room #4. Facility was observed with a working telephone service on the premises.

Facility uses sign in and out sheets for authorized parent/ guardian to sign in and out daily. Director states wellness checks are conducted at drop off to ensure children are well to attend program.

LPAs advised smoking is prohibited on the premises of a child care center as specified in Health and Safety Code Section 1596.795(b). LPAs advised a baby walker shall not be allowed on the premises of a child care center in accordance with Health and Safety Code Sections 1596.846(b) and (c).

LPAs advised there shall be at least 35 square feet of indoor activity space per child based on the total licensed capacity. LPAs advised based on the total licensed capacity, one toilet and one handwashing fixture shall be maintained for every 15 children, or fraction thereof.

Napping:

Cots used for napping were observed to be maintained in a safe condition. Covered with vinyl or similar material that can be wiped. Director stated cots are wiped with a detergent/disinfectant weekly or when soiled or wet.

Each cot or mat shall be equipped with a sheet to cover the cot or mat and, depending on the weather, a sheet and/or blanket to cover the child, Director stated children bring their own bedding from home.

LPAs observed a variety of age-appropriate equipment, toys and materials in good condition and in sufficient quantity to allow children present to fully participate in planned activities.

Restrooms:

All toilets, handwashing facilities were observed to be maintained in safe and sanitary operating condition. LPAs advised additional equipment, aids and/or conveniences shall be provided as needed in centers that serve children with physical disabilities.

Hot water was not observed in children’s hand washing sinks. LPAs advised hot water temperature controls shall be maintained to automatically regulate temperature of hot water delivered to plumbing fixtures used by children to attain a hot water temperature of not less than 105 degrees F (40.5 degrees C) and not more than 120 degrees F (48.8 degrees C).

LPAs advised notwithstanding (e) and (e)(1) above, handwashing fixtures shall not be required to deliver hot water.

Restroom for children in isolation area will be located in the staff bathroom on the 2nd floor. LPAs advised common towels or washcloths are prohibited.

Outdoor:

LPAs observed a shaded rest area for the children. LPAs advised per regulation 101238.2(d)(2) Free of hazards including, but not limited to, holes, broken glass and other debris, and dry grasses that pose a fire hazard. LPAs observed a metal grate located on the ground near the entrance to the sandbox area as in need of repair with sharp points. Facility maintenance placed a piece of duct tape over sharp point temporarily until repaired. LPAs observed the areas around and under high climbing equipment and slides to be cushioned with material that absorbs falls.

LPAs advised sandboxes shall be inspected daily and kept free of hazardous foreign materials. No foreign materials were observed in the sandbox area.

The playground was observed to be enclosed by a fence to protect children and to keep them in the outdoor activity area. The fence was observed to be at least four feet high.

LPAs advised any construction or equipment that could pose a hazard in the outdoor activity area shall be made inaccessible to children in care. This shall include, but not be limited to, incinerators, air- conditioning equipment, water heaters, and fuse boxes.

No pools or other bodies of water were observed. Facility does have a water fountain located on the playground with water off. Water fountain was observed empty. LPAs advised there shall be at least 75 square feet per child of outdoor activity space based on the total licensed capacity.

LPAs advised medications shall be kept in a safe place inaccessible to children. Medication authorization form signed by parent was observed in room #7, medication stored in classroom closet. LPAs advised a refrigerator shall be used to store any medication that requires refrigeration. Director stated refrigerator medication will be stored in directors office. LPAs observed facility is using LIC9221 Parent Consent for Administration of Medication and Medication Chart.

Food Service:

Facility was observed with a warming kitchen. LPAs advised all food shall be safe and of the quality and in the quantity necessary to meet the needs of the children. Each meal shall include, at a minimum, the amount of food components as specified by Title 7, Code of Federal Regulations, Part 226.20, (Revised January 1, 1990) Requirements for Meals, for the age group served. Menus were observed with recommended serving sizes. LPAs advised all food shall be selected, stored, prepared and served in a safe and healthful manner.

All foods or beverages capable of supporting the rapid and progressive growth of microorganisms that can cause food infections or food intoxications shall be stored in covered containers at 45 degrees F (7.2 degrees C) or less. Refrigerators were observed with thermometers reading at 40 degrees.

No pesticides or other similar toxic substances were observed in food storerooms, kitchen areas, food-preparation areas, or areas where kitchen equipment or utensils was stored. LPAs advised soaps, detergents, cleaning compounds or similar substances shall be stored in areas separate from food supplies.

The kitchen, food-preparation and storage areas were observed to be clean and free of litter and rubbish. LPAs advised the food-preparation area shall not be used for: Children's play activities, unless such activities are part of a supervised food-education program. Facility provides lunch and two snacks per day.

Postings:

LPAs Lowe and Laureano observed the following postings outside of Director office: Current facility license, LIC 613A (9/96), the PUB 393 (8/02), Child Care Center Notification of Parents' Rights Poster, LIC 610 Emergency Disaster Plan with the telephone number of the local health department, information on child passenger restraint systems, and a contingency plan for action during fires, floods and earthquakes.

Menus were observed to be in writing and posted in each classroom to be review by the child's authorized

representative. LPAs advised copies of the menus as served shall be dated and kept on file for at least 30 days. Menus shall be made available for review by the child's authorized representative and the Department upon request.

LPAs observed facility has a disaster and mass casualty plan of action in writing.

LPAs advised the licensee shall reveal each child care center license number in all advertisements in accordance with Health and Safety Code Section 1596.861.

The following items were discussed:

Facility representative was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with facility representative and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed facility representative of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

The following corrections are needed before a capacity increase will be considered. Corrections are due by 9/30/2022:

An exit interview was conducted with the above items discussed appeal rights and a copy of this report was provided to the Preschool Director, Chaya Rotenberg. Final license determination will be made upon review by the Licensing Program Manager and correction of the above issues.
