Due to the Safer at Home Order issued by California State Governor Newsom, on 11/17/2020 at 2;45 pm, Licensing Program Analyst (LPAs) Lourdes Castellanos, conducted a Tele-Conference with Director Natasha Madison, for the purpose of concluding the investigation regarding the above allegations. During the investigation, LPA Castellanos and Hill conducted interviews, with the Director, staff, parents, and reviewed child care policies and records on 5/21/2020, 06/03/2020, and 06/24/2020.

LPA Castellanos attempted to verify the allegations, given that the witnesses (Director, Authorized Representative, and the parent of C1, C2, and C3) recanted the allegations. However, LPA Castellanos has been unable to reach the parties to verify that they were recanting the allegations.

Allegation 1 and 3 - Representatives, parents, and staff interviewed stated they have never seen or heard of teachers rough handling or yelling at the children while in the facility. On 11/03/2020 LPA interviewed Authorized Representative of C1 who stated that the child is still attending the facility Monday-Friday from 8:30am to 4pm.

The Authorized Representative stated she observes C1 excited and happy during drop off. The Authorized Representative also stated she has daily communication from the staff about C1’s daily activities, has never had an issues with the facility, and has never observed bruises or marks on C1.”On 6/24/2020, LPAs Castellanos and Hill received records from the Director revealing that infant staff completed trainings on 5/6/2020 pertaining to children’s challenging behaviors, child discipline, and children’s personal rights.

Allegation 4 - Evidence provided to LPA Castellanos include photos that did not include a date or a diagnosis by a physician. Interviews with staff and parents revealed that the facility was not recently exposed to hand, foot, and mouth disease. The Director provided LPA Castellanos with a notification letter that would be given to the parents in the event of exposure.

Based on records reviewed, documents obtained, observations, and interviews conducted by the Department on the allegations were found to be Unsubstantiated. Unsubstantiated means that although the allegations may have happened or are valid, there is not a preponderance of evidence to prove that the alleged violations occurred.

An exit interview was conducted. A copy of this report (LIC9099, LIC 9099C) and a Notice of Site visit was emailed to Director Natasha Madison. It has been explained that a reply to the email shall be considered a substitute for the hard-copy signature.
