During the investigation LPA Odom interviewed complaining party, Director, 6 staff members, and 7 children. LPA reviewed the Children’s Roster, personnel report, and personnel records.
During an interview on 7/11/2022, the Director (S7) stated they have not observed S1 push a child out of a line. S7 disclosed there was one incident when S1 brought Child #1 (C1) into the office because they were not behaving, S7 observed S1 was holding C1 from the wrist and S7 immediately told S1 not to hold children’s wrist only from the hand. The children in the 2-year-old classroom wear pull ups and practice potty training, they have potty chairs in the classrooms. If a potty chair is used there are bags inside the potty chair that staff will tie them up and throw them away.
LPA Odom interviewed six staff members on 7/11/22, 8/8/2022 and 8/11/2022. Five out of six staff have never observed S1 handle children in a rough manner or push a child out of a line. Staff #6 (S6) stated they observed S1 pick up child #6 (C6) from the arms and verbally threaten child. S6 disclosed Staff #3 (S3) also observed the incident. During an interview with S3, S3 never disclosed observing S1 picking up C6 from the arms. Staff #4 (S4) stated when they began to hear rumors regarding S1, S4 would randomly show up in S1’s classroom to check in multiple times throughout the day and during outdoor play as well. S4 never observed S1 handling children in a rough manner. S1 stated they don’t discipline the children they have common areas that are used to calm their bodies and we don’t give time out. None of the staff disclosed S1 was not meeting children’s toileting needs.
LPA Odom interviewed 7 children on 7/20/2022 and 8/8/2022 and 8/26/22. During the interviews, C6 disclosed S1 never picked them up from the arms. None of the children disclosed S1 grabbing them in a rough manner. The children disclosed they are placed on time out or sent to the calming corner.
Based on LPA’s facility inspection, observations, interviews conducted with complainant party, director, 6 staff members, 7 children and records reviewed it was determined there was insufficient evidence to confirm that S1 handles daycare children in a rough manner and S1 do not meet daycare children’s toileting needs. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are Unsubstantiated.
