Licensing Program Analyst (LPA) Lucero conducted an unannounced complaint investigation. This is a continuation of the investigation initiated on 05/10/2023. Upon arrival LPA met with Director Monique Gonzalez, to deliver complaint findings. Director guided LPA on a tour of the facility. LPA took census, there were a total of 33 preschool children and 4 staff.

A review of staff records on this date indicated that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.

The Department received a complaint on 05/09/22 alleging facility is not providing adequate supervision to day care children. Reporting party (RP) reported witnessing on the video camera mounted in the classroom, a child standing up on the changing table with no teachers seen close by. RP stated that this was not the first time they observed a child unsupervised on the changing table.

During the investigation LPA Lucero interviewed 3 staff members, interviewed 4 parents, conducted a facility inspection, took picture of the changing area, and reviewed the facility footage of classroom.

During staff interviews, 3 out of 3 staff disclosed in classroom C there is moveable little stairs for the children that lead to the changing table that children like to play and climb on. Staff disclosed all throughout the day staff are constantly having to ask children to get off the little stairs when they are playing on it to prevent injuries. 3 out of 3 staff denied ever witnessing another staff leave a child unattended at the changing table or seeing a child stand on the changing table without staff. On other facility visit on 05/26/2023, LPA inspected classroom C and observed the little stairs were removed from the class.



LPA reviewed video footage received from facility for the time period in question. LPA did not observe any child left unattended on the changing table or a child stand on the changing table without staff.

LPA Lucero attempted to contact 11 parents by phone and was able to interview 4 parents. All interviewed
parents stated they did not have any concerns with the facility and made no disclosures

Based on LPA’s facility inspection, observations, 3 staff interviews and 4 parents interviewed, it was
determined there is insufficient evidence to corroborate the allegation, facility staff did not adequately supervise a day care child. Although the allegation may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is Unsubstantiated.

Exit interview was conducted with Director Monique Gonzalez. Notice of Site Visit was posted during the visit. Director was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Director was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. First level appeals should be sent to the regional manager to the address listed above.
