Licensing Program Analyst (LPA), Mila Quinto conducted an investigation visit to the facility to deliver the findings. LPA met with Director, Sara Ortiz. The Covid-19 Emergency Response questionnaire was reviewed and answered by the director. Census was taken. There was a total of 43 preschool children with 7 staff in different classrooms.
A review of facility Personnel Report Summary on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.
Facility representative was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

The complainant alleged the facility is malodorous. Classroom 2 has a foul smell of dirty water coming from the turtle tank and smell of dirty diapers.

On 04/25/2022 LPA interviewed Reporting Party (RP) who stated that the turtle tank smelled, the complainant reported it to the director, the following day, the water was cleaned. RP also stated when RP walks in the room, it smells of dirty diaper.

On 4/28/22 and 7/12/22, LPA conducted an interview with 6 staff members including the director. According to the Director, the turtle tank gets cleaned about 2-3 times per month. However, if there is a foul smell, Director will inform Staff 3 (S3) and S3 will clean the tank. Director also indicated there are many children in the classroom 2 that are being potty trained. The urine diapers are thrown in the covered trash bins while soiled diapers are placed in a plastic bag and directly thrown away to the outside trash bin.

LPA attempted to interview 4 children. However, LPA was not able to qualify the children, due to age and limited language skills to be interviewed.



On 6/09/22, LPA called 10 parents and interviewed 4 of the 10 parents. There were no disclosures made from the 4 parents interviewed. LPA did not receive a return call from the other 6 parents.

Based on interviews conducted, the complaint alleging the facility is malodorous is found to be unsubstantiated. Although the allegation may have happened or is valid, there is not enough preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.

The complainant alleged staff are not properly cleaning daycare children’s cups.

LPA interviewed RP on 04/25/2022, who stated that the children’s cups are left on a dirty bucket.

On 4/28/22 and 7/12/22, LPA conducted an interview with 6 staff members including the Director. The Director stated the kitchen staff will bring the cart with snacks/lunch and drinks in each classroom. The cart is cleaned by the kitchen staff after each use. The cart is always cleaned each time after used. The 5 staff also indicated the cart is cleaned when they are brought inside the classroom. Staff 2 (S2) and S3 stated a bucket containing the children’s bottle water are cleaned daily and there is a separate bucket to place dirty bottled water. On 4/26/22 and 7/12/22, LPA observed the bucket with children’s bottle water and a separate bucket labeled as dirty bottles. LPA observed the bucket containing the children’s bottle water were clean and sanitary.

LPA attempted to interview 4 children. However, LPA was not able to qualify the children, due to age and limited language skills to be interviewed.

The complainant alleged staff did not safeguard daycare children’s personal belongings. The complainant indicated children are coming home with missing personal belongings or other children’s belongings.

On 04/25/2022 LPA interviewed RP who stated that RP’s children are coming home without their belongs or with other children’s belongings. RP states when speaking to the director about the allegations, RP stated that the director stated that the child must have left their belongings at the playground or other excuses.

The facility also has a lost and found area. The director stated that neither staff nor parent has not brought it to her attention about missing children’s belongings. The 3 staff interviewed stated that the children have their names on their belongings and if items are missing, staff will look for them and place it back in the child’s cubby. There was no disclosure on the 2 of the 6 staff interviewed.

Exit interview was conducted. Notice of Site Visit was posted during the visit. Director was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Director was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights.
