On 01/19/2023, at approximately 9:00AM, Licensing Program Analyst (LPA) Arianna Manabat conducted a case management visit based on observations observed while present in the facility. Upon arrival, LPA observed 44 children, supervised by 13 staff and Director and Assistant Director.

During the inspection, LPA Manabat conducted interviews with five staff members and attempted two children's interviews. During interviews, it was stated that the facility had been operating out of ratio from approximately 9:05am to 9:30am. Record reviews indicate that room E had a total of 14 children at one time until Child 1 and 2 (C1) and (C2) were moved to room D at 9:30.

At approximately 10:35am, LPA Manabat was present in room E and observed Child 3 (C3) open the classroom door and exit the classroom into the hallway while staff 1 (S1) was attending to two children who were standing on stacked wicker bins approximately two feet high. At approximately 10:40am LPA observed two children running in the classroom and climbing onto stacked cots. S1 was able to ask the children to climb down but could not physically attend to the children as S1 was supervising seven other students at the time. At approximately 10:45am, LPA Manabat observed three children enter into the classroom restroom unattended for approximately thirty seconds. During this incident, S1 was able to open the restroom door and ask the children to leave the restroom as the children were utilizing this space as activity space. Lastly, it was stated that a child (C4) had exited the classroom and into the playground at approximately 10:00am.

After the incident, LPA observed Director interact with C3 and C4 and was able to redirect the children by staying with them for approximately five minutes and helping them to successfully reenter into the classroom. C3 then had to be taken out again and the Director was able to assess situation and allow the child to play successfully in a 1:1 environment for approximately 45 minutes.

Based on observations, interviews with staff members, and record review, LPA Manabat has determined that the facility has operated out of ratio and that there has been a lack of supervision, which is an immediate risk to children in care. The facility has been assessed two Type A deficiencies for the violations mentioned above. Deficiencies are listed on the following 809D page.

Director acknowledges, that for TYPE A DEFICIENCIES ONLY upon receipt, Directors shall post LIC 9099-D with Type A deficiency for 30 days and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. LIC9224 must be signed by parents/guardians and kept with the children's forms as a receipt whenever any Type A documents are provided by the Directors. LIC9224 and Appeal Rights were provided. An exit interview was conducted and a Notice of Site Visit posted.

Director has implemeneted a behavioral plan for children regarding opening the doors. Director is currently hiring staff members to provide more supervision in the classroom. Director will send LPA action plan signed by parents.
