Licensing Program Analysts (LPA) Alda Aguirre conducted a Case Management Visit, during the visit LPA toured the facility and observed the following deficiencies:

102417(g)(5) Operation of a Family Child Care Home. All pools, spas, hot tubs, fish ponds, or similar bodies of water shall be covered or fenced as specified to be inaccessible to children. LPA observed a spa in the backyard outside that was unlatched and unlocked. Although the spa was not filled with water, there was enough water inside to pose an immediate risk. (Pictures on file.) This is a zero tolerance violation, civil penalties have been assessed.

102370(d)(1) Criminal Record Clearance. All individuals subject to a criminal record review as specified in Section 1596.871 prior to working, residing or volunteering in a licensed home, shall obtain a California clearance or a criminal record exemption as required by the Department. LPA learned that the licensee's mother, Joyce Belu-Johnson, has been assisting with the daycare, picking up and dropping off the daycare children from school and bus stops during this school year without a fingerpirnt clerance. Elisse Williams also worked as an assistant for the daycare, Summer through the third week of September without a fingerprint clearance. Civil Penalties have been assessed for $100 per day for a maximum of 5 days for the first offense, for each individual.

102417(b) Operation of a Family Child Care Home. The home shall be kept clean and orderly, with heating and ventilation for safety and comfort. During the visit LPA observed bags of recyclable trash inside the home in areas that were accessible to children. Spider webs, dirt, trash were observed on the play equipment in the backyard outside that is the area that was designated as outdoor play space.

102417(g)(3) Operation of a Family Child Care Home. Where children who are less than five years old are in care, stairs shall be fenced or barricaded. Four of the children in care are less than five years old and the stairs were not barricaded or fenced during the visit.

LPA observed ant bates in the kitchen area that were accessible to children because the children were in the living room area next to the kitchen during the visit. LPA also observed lighter fluid and charcoal outside in the backyard.

Upon receipt, licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility for the next 12 months.

The Notice of Site Visit and Type A Deficiencies from today’s visit must be posted for 30 days. Failure to keep these posted for the entire 30 days will result in an immediate $100 civil penalty for each.

During the visit the licensee, latched and locked the spa cover. The licensee has agreed to provide a statement, to CCL by 10/26/17, that she will check the spa daily before any child arrives to the daycare to ensure the cover is latched and locked. This is a zero tolerance violation, civil penalties have been assessed for $500.
