|Licensing Program Analyst (LPA) Alda Aguirre arrived at the facility to conduct a Case Management visit. During the visit LPA entered the home and smelled smoke. LPA asked the licensee if anybody was smoking in the home, the licensee stated that nobody was smoking in the home. When LPA toured the home LPA entered the licensee's bedroom and smelled a stronger odor of cigarette smoke. LPA informed Ms. Reece that somebody was definitely smoking in the home. Ms. Reece stated that her ex-husband smokes and he was there 15 minutes earlier and was smoking in her bedroom but that he left. The licensee knows that Mandrell Carter does not have a fingerprint clearance and should not be in the facility smoking during daycare hours. .|
102402(3) Revocation or Suspension of a License or Registration. Conduct in the operation or maintenance of a family day care home which is inimical to the health, morals, welfare, or safety of either an individual in or receiving services from the facility or the people of the State of California. The licensee's conduct is inimical to the health and safety of children in care because she allowed her ex-husband, Mandrell Carter, to be present in the home smoking during daycare hours when there were children present. The licensee is also aware that Mr. Carter does not have a fingerprint clearance or an exemption.
102424(a) Smoking Prohibited. Smoking is prohibited on the premises of a family child care home as specified in Health and Safety Code Section 1596.795(a). Because the licensee allowed her ex-husband, Mandrell Carter, to smoke in the home during daycare hours when there were 2 children present this deficiency was cited.
102417(g)(3) Operation of a Family Child Care Home. Where children who are less than five years old are in care, stairs shall be fenced or barricaded. During the visit LPA observed that the stairs were not barricaded. There was a gate propped onto the stairs but it was not attached to the sides and did not barricade the stairs. This is a repeat violation. Civil Penalties have been assessed.
