Licensing Program Analyst (LPA) Alda Aguirre visited the facility to complete the investigation into the above-allegation. During the investigation, interviews were conducted and records were reviewed.

The investigation revealed that an allegation was made that the licensee failed to pick up a child from school.

102417(a) Operation of a Family Child Care Home. The licensee shall be present in the home and shall ensure that children in care are supervised at all times. During witness interviews it was learned that on more than one occasion, the licensee failed to pick up children from their bus stop and from school. On one occasion, a child was left at the school until the child was picked up late but on another occasion, children were not picked up from their bus stop. The children were at the bus stop without supervision until the licensee's mother picked up the children. The licensee's mother, who was responsible for picking up the children did not have a fingerprint clearance (cited on 10/25/17). Children left in the absence of supervision is a zero tolerance violation, civil penalties have been assessed.

102416.2(b) Reporting Requirements. The licensee shall report to the Department any of the events as specified in Health and Safety Code Section 1597.467(b)(1)(A) through (b)(1)(C) that occur during the operation of the family child care home. The licensee failed to report to CCL that children had been left without supervision when a child was left at school and when the children were left at the bus stop.

Based on information obtained during interviews conducted, and licensee’ own admission the above allegation has been deemed to be Substantiated, based on the preponderance of evidence.

An exit interview was conducted, Notice of Site Visit posted, appeal rights discussed and given to the licensee along with a copy of this report and an LIC9224..



THIS REPORT MUST BE AVAILABLE TO THE PUBLIC FOR THREE YEARS.

Upon receipt, licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility for the next 12 months.

The Notice of Site Visit and Type A Deficiencies from today’s visit must be posted for 30 days. Failure to keep these posted for the entire 30 days will result in an immediate $100 civil penalty for each.

Licensing Program Analyst (LPA) Alda Aguirre visited the facility to complete the investigation into the above-allegation. During the investigation, interviews were conducted and records were reviewed. The investigation revealed that an allegation was made that a daycare child sustained suspicious injuries while in care. During the interviews conducted, there were no witnesses that have seen the licensee or her assistants use corporal punishment as a form of discipline. There are witnesses that have stated that the child did not receive the injury prior to arriving at the facility, or after leaving the facility however, there are witnesses who state that the incident did not happen at the facility. Although the incident may have happened, or the allegation may be true, there are conflicting statements as to how the child was injured. Based on a preponderance of evidence the allegation that a daycare child sustained suspicious injuries while in care has been Unsubstantiated.
