Onsite inspection made by Licensing Program Analyst (LPA) Vicky Williamson to complete complaint investigation initially conducted on 3/5/18. Met with Assistant Director Jennifer Phillilps. The following ratios were observed during inspection:
Room #4 (2 - 3 years) 20 napping children present with 2 qualified teachers.
Room #5 (4 - 5 years) 20 napping children present with 2 qualified teachers.
Room #7 (3 - 4 years) 16 napping children present with 2 qualified teacher.

It was alleged that a day care child was left unattended on the playground. Interviews were conducted with several staff members, day care children, and day care parents. On or about, 2/26/18, staff members stated that child #1 was observed outside of preschool classroom #7, alone and without direct supervision inside of the locked gate outside of preschool classroom #7; during transition from playground to classroom. According to staff, the child was left unsupervised for approximately 2 minutes. Staff disclosed that child #1 was observed to be missing from the classroom.

On 3/5/18, during the initial inspection Director discussed with LPA a plan to ensure that staff provided proper care and supervision to children in care. Asst. Director Jennifer Phillips stated that retraining of staff members on CSR proper name to face, and supervision was conducted on 4/11/18.

Director provided LPA with training topics covered (personal rights and disipline, supervision and CSR proper name to face), agenda, and attendence log. Preschool door leading to outside was repaired on 3/29/18, allowing the door to close securely. POC cleared 4/26/18.

THIS IS AN AMENDED REPORT FROM THE ORIGINAL DRAFT DATED 4/26/18

Child #1 disclosed that she walked out of classroom #7 alone exiting the preschool classroom door leading to the gate.

Based on the information obtained during the course of the investigation, the preponderance of evidence standard has been met that the facility staff failed to provide adequate supervision, resulting in a child leaving the classroom unnoticed and without supervision, therefore the above allegation is found to be SUBSTANTIATED. This is a repeat violation because the facility was cited for the same violation on 3/29/18, for failure to provide adequate supervision to child #1 resulting in the child walking out of preschool classroom #7 into the hallway of the facility. A civil penalty of $250 was assessed for repeated violation within 12 months.

Please refer to LIC 9099D for deficiency cited per CCR, Title 22, Division 12, Chapter 1 regulations. Facility was provided a copy of the appeal rights form LIC 9058 and the signature on this form acknowledges receipt of these rights.

Notice of Site Visit (LIC 9213) was provided to be posted at the facility for 30 days. LPA observed form LIC 9213 posted.

AB633 requires upon receipt, Licensee shall post (observed by LPA) and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. An Acknowledgment of Receipt of Licensing Reports, Form LIC 9224 must be signed and placed in each child’s file.
