Licensing Program Analyst (LPA) Vicky Williamson arrived at the facility to conduct a case management inspection to follow up on an incident report. LPA Williamson met with Maritz Renteria, Director. There were 44 children being supervised by 5 staff members.
On October 10, 2018, the director self- reported an incident of possible personal rights violation that allegedly occurred on October 10, 2019.
On October 10, 2018, it was alleged that Staff #1 was observed by Staff #2 stating to Child# 1, “Stop running and come and get your diaper changed.” Staff #2 stated that she did not hear the entire conversation between Staff #1 and Child #1 but that she did hear Staff #1 say, “or I will smack you." On 10/10/18, Staff #1 provided a statement to the Agency stating that the children were running and throwing toys all over the place in the classroom. Staff #1 stated that Child #1 was slapping and smacking another child. Staff #1 stated that she kneeled down and told Child#1 to stop smacking Child #2. Staff #1 stated that she asked Child #1, “How would you feel if I smacked you, you need to listen to my words and stop.” Staff #1 stated that Staff #2 misunderstood what she said and reported something completely different to the Director. Director stated that she spoke to Staff #1 regarding the incident. Director stated that Staff #1 stated that she told Child #1, "You are smacking other people, what will happen if I smack you." Director stated that she advised Staff #1 that she violated the child's personal rights. Staff and children’s records were reviewed. Interviews were conducted with director, assistant director, and several staff. Based on evidence obtained, it was determined that Staff #1 violated the personal rights of Child #1.
This is a repeat violation because the facility was cited for the same violation on 9/6/18, for violation of a child’s personal rights. An immediate civil penalty of $250 was assessed for repeated violation within 12 months.
See LIC 809D for deficiency citations. Facility was provided a copy of the appeal rights form LIC 9058 and the signature on this form acknowledges receipt of these rights.
The Notice of Site Visit (LIC 9213) was provided to be posted at the facility for 30 days. LPA observed form LIC 9213 posted. An exit interview was conducted.
