On 05/21/2025 at 1:00PM, Licensing Program Analyst (LPA) Saul Zazueta conducted an unannounced complaint inspection to deliver the findings for the above allegation. LPA met with Director, Ana King, and advised director of the purpose of the inspection and conducted a tour of the facility. There were thirty-four (34) children and nine (9) staff present during the inspection.

During the course of the investigation, LPA conducted interviews with director, facility staff and daycare parents. LPA did not conduct child interviews due to lack of verbal ability in infant children. Photos, bottle feeding policy, and facility roster were obtained and reviewed by LPA.

Based on interviews conducted and records reviewed, it was determined that on 03/03/2025, a bottle of breastmilk was given to the wrong infant by Staff #5 (S5). Director and facility staff involved confirmed the incident occurred. (Continued on attached 9099-C).

According to the Director, it was discovered the wrong bottle was fed when the mother picked up the infant from the program and was given an empty bottle that did not belong to them. Director stated that it was discovered that the bottle belonged to another infant in the program. During today’s inspection, LPA observed training records that indicates all facility staff received training on infant feeding.

Based on LPA interviews conducted, and records reviewed, the preponderance of evidence standard has been met, therefore the above allegation(s) is found to be SUBSTANTIATED. One (1) type B deficiency of California Code of Regulations, [Title 22, Division 12, Chapter 1, Section 101223 (a)(2)], is being cited on the attached LIC 9099D.

Exit interview was conducted and this report was reviewed with Director, Ana King. A Notice of Site Visit was provided and must remain posted for 30 days.

Director stated that they conducted training on bottle feeding, on March 20th, 2025, and will submit a sign in sheet of all staff that participated to the SDRO by 5/23/2025.

Based on analyst interview and record review, the facility did not comply with the section cited above as they mistakenly fed an infant a bottle with breastmilk that belonged to another infant, which poses a potential health, safety, and personal rights risk to children in care.

LPA met with Director, Ana King, and advised director of the purpose of the inspection and conducted a tour of the facility. There were thirty-four (34) children and nine (9) staff present during the inspection.

During the course of the investigation, LPA conducted interviews with director, facility staff and daycare parents. LPA did not conduct child interviews due to lack of verbal ability in infant children. Facility roster was obtained and reviewed by LPA.

It was alleged that Staff #5 (S5) is “abusive” to infants in care, no other specifics were provided. Director and staff interviewed denied the allegation and did not share any concerns regarding abusive interactions between staff or children. Parents interviewed stated that they believe the facility provides a safe environment for children and are satisfied with the program and staff.

Due to a lack of supporting evidence and no other witnesses to the alleged incidents to corroborate the above allegations, LPA was unable to determine, whether or not staff are abusive to infants in care. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is UNSUBSTANTIATED.
