On 10/25/24, at 8:45 AM, Licensing Program Analysts (LPAs) Elizabeth George and Elvin Baddley conducted an unannounced required 3- year Inspection at the above-mentioned family child care home (FCCH). LPAs met with Licensee Claudia Legorreta and explained the purpose of the inspection. LPAs, in the company of the Licensee, toured the interior and exterior of the FCCH. At the time of the inspection six children were present along with Assistants, Ignacio Legorreta and Nancy Castro. Hours of operation are M-F, 6AM-6PM.

This is a single story home with three bedrooms, two bathrooms, living room, dining room, kitchen, backyard and garage. Licensee stated that children have access to the living room, dining room, bathroom, kitchen, and backyard. While the three bedrooms, one bathroom and garage are inaccessible to children in care. The home was orderly and clean with proper ventilation for all children in care. The bathroom used for care is clean and free of toxins. LPAs observed a fireplace in the living room that is covered by a cabinet and made inaccessible to children. LPAs observed three pack n plays in the FCCH that meet regulations. LPAs observed an infant swing which was checked against the recall website and meets regulations. LPAs observed that sharps, knives and medications are stored in the kitchen on a high cabinet that is inaccessible to children in care. LPAs observed that cleaning compounds are stored above the refrigerator as well as in a locked shed in the backyard. Toys, furniture and equipment in the FCCH are age appropriate.

LPAs observed required licensing forms and documents posted within the FCCH. LPAs observed a smoke detector located in the living room which was tested and found to be operational at 9:03 AM. Carbon Monoxide detector was located in the hallway and was tested at 9:31 AM and found to be operational. LPAs observed a regulation fire extinguisher that was serviced 1/29/24. LPAs reminded the licensee to either service or purchase a regulation fire extinguisher annually. LPAs reviewed the FCCH’s fire/disaster drill log. The most recent fire drill was conducted on 7/31/24.

LPAs observed the backyard to be completely fenced. The FCCH was observed to have plenty of shade for the children in care. Toys and play equipment observed in backyard are age appropriate and in good conditions. LPAs observed one small shed in the outdoor play area that is locked and inaccessible to children. LPAs observed no bodies of water on site. Licensee informed LPAs no firearms or ammunition are in the home.

A sample of children’s records were reviewed. All records reviewed are current. The current roster of children was reviewed. All children present during the inspection are noted on the roster. LPAs reviewed the licensee’s Pediatric CPR/First Aid certification which was completed on 8/20/23. Review of staff files showed that none of the staff have current Mandated Reporter certification. LPAs reminded licensee of the obligation to ensure that mandated reporter is up to date. Staff records were reviewed and found to be complete. LPAs observed two small dogs on site, reviewed the vaccination records and found to be current.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

LPAs discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPAs also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

A Type B Deficiency is being cited based on LPAs' observation/interviews/record reviews pursuant to Title 22 of the CA Code of Regulations and HSC 1596.8662(b)(1) (refer to LIC 809-D). Licensee was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights.

During the exit interview, the licensee confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS.

A notice of site visit was given and must remain posted for 30 days.
