A subsequent complaint investigation inspection was conducted at the facility by Licensing Program Analyst (LPA) Patricia Pacheco. It has been alleged that the licensee failed to provide daycare children with adequate meals, specifically that children were not provided lunch or snacks on a Saturday when in care. The licensee stated that she feeds children adequately. The licensee stated that she usually allows children to sleep in on Saturdays and prepares a large brunch for them. The licensee stated that there are also plenty of snacks including fruit that are available before and after all meals if children are hungry. The licensee stated that she asks parents to bring snacks for all children to share while in care. During the course of the investigation, the facility was inspected on 09/25/18, 10/03/18 and 11/07/18. LPA observed that there were meals being prepared during the inspections and there were snacks available to children on the counter. During the investigation, child, staff and witness interviews were conducted. It was corroborated that sufficient meals and snacks are provided and that children receive snacks between meals. Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred and the findings are unsubstantiated.

It has been alleged that the licensee failed to meet a child's toileting needs; specifically, that a child was not assisted or allowed to use the restroom while in care. The licensee stated that she and her assistant encouraged the child to use the restroom and have never prevented a child from using the restroom. During the course of the investigation, the facility was inspected and it was observed that the bathroom is accessible to children in care. During the investigation, child, staff and witness interviews were conducted. It was corroborated that that children are not denied use of the bathroom and that children are offered assistance when they need it. Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred and the findings are unsubstantiated.

It has been alleged that the licensee made inappropriate comments to day care children and threatened a child; specifically, that her family children “were beatable” and that the licensee threatened to put a child in a dark room by herself if she did not behave. The licensee stated that she does not make inappropriate comments to day care children. The licensee stated she loves the children that she provides care for and would never threaten them. The licensee stated that the only form of discipline that she uses is time outs. The licensee stated that children sit on a step in the dining room or away from the other children in the same room for time out. The licensee stated that children are sent to one of the bedrooms only if they are displaying physical or severe behavior which requires a parent telephone call for early pick up, but that the light is never turned off. During the course of the investigation, the facility was inspected on 09/25/18, 10/03/18 and 11/07/18. LPA observed that the licensee was interacting appropriately with children in care. During the investigation, child, staff and witness interviews were conducted. It was corroborated that the children do not feel threatened or afraid of being physically reprimanded by the licensee. It was further corroborated that the step and bedroom are used as time out places for children and that the lights are not turned off in the bedroom except for during nap times. Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred and the findings are unsubstantiated.

All licensing reports are public information and must be made available upon request for at least three years. There were no Title 22 deficiencies cited during today's inspection.
