An informal office meeting was conducted today at the Fresno Regional Child Care Office. In attendance at the meeting were Prudy Tanner, Lucinda Tanner-Jewell, Kawanda Pettitt, Licensing Program Analyst, Norma Lomeli and Licensing Program Manager, Duane Matsubara .

The purpose of this meeting was to discuss the following topics:
  • In regards, to deficiency cited on 1/4/2016 - 101238(a) - Buildings and Grounds. The child care center shall be clean, safe, sanitary and in good repair at all times. Center heating unit in the Toddler room has not been working since 11/10/15 or before. Licensee stated that she was unaware that a broken heater needed to be reported to CCL. Licensee was informed by Licensing Program Manager, Duane Matsubara that any unusual incident report should be called in to CCL and an Unusual Incident Report to follow within 7 days. The heater has been repaired as of 1/4/2016.
  • Lucinda Tanner-Jewell stated that due to funding purposes and Title 5 Regulations the program has designated different titles for the administration: Director, Program Manager and Site Supervisor. Licensee stated that they currently have six cites that are licensed.

  • Parent of child who was touched during nap time was not informed of the incident by staff in a timely manner.

Type A Deficiencies
Complaints:
  • 1/4/2016 - 101223(a)(2) - Personal Rights. Each child shall be accorded safe, healthful and comfortable accommodations, furnishings and equipment. Child #2 was touched inappropriately by Child #1. Child #1 had previous history of this behavior. Staff failed to protect Child #2 by not providing the supervision necessary to ensure the safety of the children in care. This is an immediate risk to the children in care.
  • 1/4/2016 - 101229(a)(1) - Care and Supervision. No children shall be left without the supervision, including visual observation of a teacher at any time except as specified in sections 101216.2(e)(1) and 101230(c)(1). It was determined during the investigation that the staff present who were responsible for supervising the children were working on reports and failed to provide the supervision necessary to protect the children in care. In consequence, Child #1 inappropriately touched Child #2. This is an immediate risk to the children in care. This is a zero tolerance violation and an immediate civil penalty of $150.00 and $150.00 a day until corrected.
Type B Deficiencies
Complaints:
  • 1/7/2016 - H&S 1596.8595 - Health and Safety Code Section 1596.8595 (c). - A licensed child care home shall provide to the parents of each child receiving services in the facility copies of any licensing report that documents any Type A citation that represents an immediate risk to the health, safety, or personal rights of children in care as specified in paragraph (1) of subdivision (a) of Section 1596.893b. LPA determined through interviews that Parents were asked to sign the LIC9224 and staff explained the violations, unless the parent asked for a copy they were not given one. This is a potential risk to the health and safety of children in care.
  • 1/4/2016 - 101212(f) - Reporting Requirements. The items specified in (d)(1)(A) through (H) above shall also be reported to the child's authorized representative. A child was inappropriately touched by another child. Licensee failed to informed child's parents of incident in a timely manner. This is a potential risk to the health and safety of the children.
Case Management:
  • 1/7/2016 - 101215.1(c)(1) & (I) - Child Care Center Directors Qualifications and Duties. Program director, Isidro Silva file did not have written statement of the administrative responsibility and authority in his file, and there was not verification of required experience. (*LPM Matsubara will review the Director's file, Isidro Silva).
  • 1/7/2016 - 101212(b) - Reporting Requirements. The name of the child care center director or fully qualified teacher(s) designated to act in the director’s absence shall be reported to the Department with in 10 days of a change. Director started in April 2015 but failed to notify CCL by sending in a director packet as of this date. This is a potential risk as CCL is not able to check qualifications and clearances.

Type B Deficiencies cont...
  • 1/7/2016 - H&S 1596.866 - CHILDCARE DIRECTOR QUALIFICATIONS: Completion of the training required pursuant to subdivisions (a) and (b) shall be demonstrated, upon request of the licensing agency by the following: A current pediatric cardiopulmonary resuscitation card & first aid certification card. The licensee could not provide copy of the CPR/FA certification.
  • 1/4/2016 - 101212(d) - Reporting Requirements. A report shall be made to the Department within 24 hours of the occurrence of any unusual incident as specified. Licensee failed to submit incident report to notify CCL the heating unit was not working.
  • 1/4/2016 - 101238(a) - Buildings and Grounds. The child care center shall be clean, safe, sanitary and in good repair at all times. Center heating unit in the Toddler room has not been working since 11/10/15 or before. Children were wearing coats in the classroom.

Administration/Duties:
  • Prudy Tanner- Director/CEO
Ms. Tanner stated that some of her duties include: funding, grant applications, hearings, attendance reports and food reports to the State of California and annual reports for Desired Results Developmental Profiles.
  • Lucinda Tanner-Jewell- Regional Manager
Ms.Tanner-Jewell stated that her duties include budgeting, hiring, staff evaluations and training.

  • Kawanda Pettitt- (Interim Site Supervisor) - Ms. Pettitt will oversee the daily operations of the program. Per Licensee, Ms. Pettitt is interim only until program hires a qualified Site Supervisor. In the case of Ms. Pettitt's absence, Diane Rhodes, Assistant Supervisor, will be in charge of overseeing the daily operations of the program.


It was discussed that continued violation of Title 22 Regulations will result in a Non-Compliance meeting and the case may be referred to our Legal Division for a possible Administrative Action.
