Licensing Program Analyst (LPA) Diana Sanchez, made an unannounced complaint inspection today and met with Director Ana King to deliver complaint finding on the above allegation. Current census is 64.

This agency has investigated the complaint alleging that Licensee failed to maintain a comfortable temperature for the children in care. During the investigation, LPA reviewed service orders, interviewed facility staff and review reports.

On 7/24/2018, during a heat wave, the facility’s air conditioning unit malfunctioned on one side of the building. At approximately 2:40 p.m., assistant director checked on classroom #7 and the temperature thermostat read at 91 degrees. She immediately called the A/C service repair unit who walked her through an attempt to restart the A/C. Children remained in the hot classrooms, for approximately one hour and twenty minutes, until approximately 4:00 p.m., when children were relocated to other classrooms.

Based on interviews conducted, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division 12 & Chapter 1), are being cited on the attached LIC 9099D.”

Fixtures, Furniture, Equipment and Supplies. A comfortable temperature for children shall be maintained at all times. The licensee shall maintain the temperature in rooms that children occupy between a minimum of 68 degrees F (20 degrees C) and a maximum of 85 degrees F (30 degrees C).

Facility implemented transferring the children to other classrooms in the afternoons, until AC unit was fixed on 8/11/2018. Deficiency has been cleared and no further plan of correction needed.

This requirement was not met as evidenced by: based on staff interviews disclosing that on 7/24/2018, classroom thermostat reading was 91 degrees at 2:40 p.m. and children were not moved out of the classroom until 4:00 p.m.
This poses a potential risk to the children’s personal rights in providing comfortable accommodations.

An exit interview was conducted with Ana King and a copy of this report and LIC-9099D left at the facility as well as appeal rights. During the course of this evaluation, LPA advised Ana that all request for extensions of any citations/Proof of Corrections (POCs) must be made within 10 days to the issuing LPA on or before the date the POC is due. Appeals to citations must be made within 15 days in writing to the issuing LPA's supervisor on or before the date the POC is due.
